Damned If You Do

  • The mother of a 24-year-old man shot and killed by a Chicago police officer during a foot chase last year is suing the officer and the city, according to court documents.

    Lashundia Key’s lawsuit says Officer Julio Garcia was careless when he shot and killed her son Aquoness Cathery in November. Key also accuses Garcia of improperly using his body camera.

    The shooting occurred around 2:15 p.m. Nov. 29 in the 6100 block of South King Drive. Cathery, of 7200 block of South Eberhart Avenue, ran from the officers while holding a handgun, according to police reports and statements at the time. After a brief chase, an officer fired his service weapon and hit Cathery on the back porch of a building.

    Cathery was rushed to Stroger Hospital, where he died the next day. A loaded 9 mm Glock handgun was recovered from the scene.
There is video at the link. Lots of video. You see the gun, see him raise it up at least once, hear the officers order up an ambulance, etc. Textbook case that cameras were explicitly designed for. So why the lawsuit (besides the fact that lawyers are scumbags at should be drowned at birth)?
  • The shooting was captured on the officer’s body camera. The footage, available on the Civilian Office of Police Accountability website, shows an officer entering an apartment and moving through a living room and kitchen after Cathery, who exited through the apartment’s back door. As the officer pursued him on the back porch, Cathery appears to have an object in his right hand.

    The officer raises his gun and fires as Cathery turns to run down a flight of stairs on the back porch.

    There’s no audio in the moments leading up to the shooting or immediately after. The audio kicks in once the officer reaches the bottom of the stairs, where Cathery is lying on the ground bleeding. At times, the view from the camera is obstructed by the officer’s arms.

    The officer tells Cathery to “relax” and calls for an ambulance.

    The lawsuit claims that the missing audio and obstructed views were intentional.
And there you have it. Anything CAUGHT on video is explained away or claimed not to be the gun (that was located at the bottom of the stairs where the subject collapsed). Anything NOT CAUGHT on the video is "intentional" a cover-up and (no doubt) will be called part of the "Code of Silence."

They get you coming and going and further make it either impossible to do the job or make you second guess yourself, thereby endangering your life.

Good job officer and welcome to the age of body cams where civil lawyers are going to start drying up on cash cow cases. Nobody is doing anything anymore and if they are it’s all being confirmed on video for all to see. The well of free money is drying up quick. Cases have two years to be filed.. that puts us at Mach of 2016 when body cams started rolling out. The stay fetal movement started about 3 months before that with JVD. Already Corp council said that filed major cases has dropped significantly. The only arrests coming in these days are traffic and Dis along with petty stuff that isn’t a big money maker anyways. Bye lawyers.. maybe go to Indianapolis or something where u can scam another big department without cameras..

Gotta say, season 2 of Z Nation is pretty good. I think I might have been watching Season 3 OR 4 of GOT during all that proactive "porch chase" policing. Anyway, life is still great even tho Netflix now charges me $11.99, but in the end watching Netflix for $11.99 beats paying punitive damages.

The Corp Counsel has a specific amount that they can settle without City Council approval. I am told it is $100,000. All the plaintiff's attorney has to do is: 1. File the lawsuit. Maybe the better idea is for Springfield to pass a law that requires gangbangers to wear body cameras at all times, 24/7/365. Then the public can actually see the caliber of person that the police have to deal with on a daily basis. You can see and hear how they talk to each other, how they treat the mothers of their various children, how they discuss guns and drugs and constantly show zero regard for their own people let alone the rest of Chicago or the police. How they have no value whatsoever for human life. It would be enlightening for the public, especially snowflake Susie and Sam out there. Maybe then the public can finally see the type of people that Toni Preckwinkle and Kim Foxx are trying to make into sympathetic heroes.

Think of all the pain and suffering the officer's family must endure because Miss Lady Key's growed-up son wanted to be a thug and play with guns. Turn the tables and sue her for naturing a monster or a menace to society.

The city and officers are sued for their training. How about parental training and let's mommies reponsible. Her failed parental training should make her accountable for her 24 year old dependent child. If Miss Lady Keys had raised her son right, he would have been an entrepreneur by now, a baby daddy of at least six shorties with different baby mamas and completed a post education G.E.D. Certificate.

Sue the mother for raising him. Its her fault the poor officer had to discharge his weapon. The officer is emotionally scared by this incident and can't sleep at night. It's the mothers fault for raising a person who would point a gun at a police officer. Sue her after the city pays her. Sue for everything she got from the city.

the union should file a lawsuit against the mayor and the dept for placing and allowing the officers of cpd into a hostile work environment. the code of silence is a made up front by the mayor to get votes. those kind of politics puts every officer and their families in the most serious of hostile environments. Compensation is necessary for that work environment and also some kind of protection is also necessary. enough already.

slow the video down in slow motion as he opens the back door to the apartment there is a 1/10 second u see the gun in his right hand as he is ruuning down the long balcony u see the gun again in his hand along with his cell phone, If you dont think you can hold both try it youreself. and as he starts to go down the stairs he levels it at the Police... The city should have slowed the video down and highlighted this stuff

I’m a CPD of 20 years. My wife is an attorney who defends Chicago police officers (among others) facing these exact lawsuits. She has successfully defended hundreds, if not thousands of officers in her career. Your comment that lawyers are all scum bags that should be drown at birth is offensive. Rather than throwing pea-brained insults at an entire profession perhaps you should narrow the scope of your ire instead of insulting those who work so hard at defending us. When people (or folks) paint our entire profession similarly with a broad brush we don’t like it, do we? Not cool, SCC.

I feel sorry for the officer. I remember years ago when these SOBs went "after the most money" meant to read: cities, government, state, business, whatever. Well, that wasn't enough. Now, go after the officer, the employee at the store, the person in the home defending themselves.

Many awards and acts of bravery as many of you yourselves have and have done. It is amazing how little this department and its unions backs and protects its officers nowadays. It is all politically motivated as not to upset potential voters. I saw my husbands spirit broken today. Something I thought I would neer see in him. He no longer sees the good in this job. The unions, the Department and the City all need to step up and stop pandering to the media and protect officers from media and law suits. This is why I tell anyone who has CCL, if they are involved in any kind of shooting, if there is a change to leave, leave the scene. If you are tracked down you can deal with it in many way's, but if you stay on that scene you're going to be subjected to all sort of bullshit. Your gun will be taken, you'll spend hours giving a bunch of different people statements, the family of the person you shot will attempt to sue you, and there's the Corner hearing that will have family members attending. Just get into the wind, fuck the system.

I've always contended that the body cam's are a trickbag because they only show one view. Honestly, who gives a shit if the audio cut out - unless the copper is an electrical engineer, how the hell does he know if the audio/video isn't working properly? And when chasing after shithead who has a weapon - do you really think it's reasonable to believe that the cop should be worrying about whether or not the fucking camera is pointed at his arm, flopping around, etc?

Forget all this nonsense - STAY FETAL, STAY EMPLOYED, KEEP YOUR ASSETS. Remember the Foghat song: SLOW RIDE....

Pull up, get out, take the report, hand them a receipt, call whatever other services are needed paramedics, fire, and then leave.

It is my sad duty to inform you that Gerald "Jerry" O'Donnell has made his transition at the age of 78. He was a 35 year member of the CPD.


Jerry was retired from the Chicago Police Department and a former instructor with the City Colleges of Chicago.

Even CNBC's Jim Cramer was taken aback by the blowout quarterly earnings report from Taser maker Axon Enterprise.

Shares of Axon roared 28 percent the day after the report and another 14 percent in the next week, making the "Mad Money" host wonder how Wall Street managed to underestimate it so dramatically.

But Axon, which changed its name from Taser International 11 months ago, hasn't exactly been sitting still.

A law enforcement technology company, Axon has broadened its specialty from non-lethal weapons like tasers to evidence capture technology, specifically audio recorders and body cameras complete with evidence management and computer-vision software.

Axon is also in a unique and beneficial position when it comes to law enforcement, Cramer said. In April, CEO Rick Smith told Cramer that Axon would give away free body cameras to every police force in the United States.

While that may have seemed like a publicity stunt, it was actually a network-building move; once Axon got police to use its hardware, they had to get the matching software to make it functional.

"The company basically traded its lumpy hardware sales ... for higher margin, recurring subscription revenue from the software side," Cramer said.

I thank your wife. But, just like the pd, corporation counsel us understaffed and undermanned. You can only do so much. Alos, they have public policy considerations to undertake and not just legal considerations. Most officers are just frustrated.

OT- Today you lost a good cop. A man who truely believed in the job, to serve and protect. A man who has put in many years to this job and city and has always done his best. Many awards and acts of bravery as many of you yourselves have and have done. It is amazing how little this department and its unions backs and protects its officers nowadays. It is all politically motivated as not to upset potential voters. I saw my husbands spirit broken today. Something I thought I would neer see in him. He no longer sees the good in this job. It is totally obvious that NO ONE, other than a very small number of community activists and some media, want this trial to happen at all.

The trial will be a media circus. Community mugging for the camera, calling "No justice, no peace." Media stroking them and the trial for ratings.

The State's Attorney and judges don't want it. The reason Alvarez shelved the case is because she saw it was not winner.

Rahm and the bossholes that OKed are going to be exposed for their role.

The outcome is not a slam dunk either way. Statutory and case law considered.

The "victim" is no prize. Drugged up and armed. Took 13 rounds before he went down.

I feel terrible for the officer and his family. Either way their lives are changed forever.

I think Rahm would like to push this case to after the 2019 election. He has his third term or not… but he gets to ride off.

And the bosses have NO plans for unrest during or after the trial.

He had no idea of what type of weapon the offender had. Last, just his appearance could have set the coward running because the shooter snuck out of the school with the other students. He wasn’t ready to fight to the death, but was a coward who had a long gun and was shooting unarmed students. Big difference between that and engaging a police officer

From what I've read it sounds like the officer did exactly what needed to be done to go home safe to his family and protect the community from this little angel.

One issue that I've noticed though, is that the body cameras have a tendency to be blocked by officers arms or are not facing the right way depending on how the officer is standing. It would be much better to have some sort of eye glasses with a camera built into the frames so it points in the same direction that the officer is looking.

Truths Regarding Lawsuits
You can be sued for merely showing up on a scene. And you can be found liable for doing absolutely NOTHING wrong.
If you arrest someone , the person gets acquitted and sues you, you can still win in federal court.
If you arrest someone , the person gets convicted and sues you, you can still lose in federal court.
Staying fetal will not save your job, or keep you out of federal court. Way back when ,Calumet City cops would not kick in a door while a little girl was being raped. They were sued . They might have prevailed.

You don't have to do any police work to be named and sued in a federal law suit. You can screw up and not get named. You can do absolute everything right, and still get named and sued and lose. And the city will settle 99 percent of the time. the way it is.
