I mean, I know he should be charged, and he probably knew it was there. And I am no fan of Cabrini Kim.

Though I'm sure his lack of admission wasn't the only reason for a denial.

Maybe learning how to establish probable cause in an arrest report might help go a long way towards getting charges approved.
"This guy was a passenger in a car, a gun was found in the car" doesn't exactly establish why HE should be charged with it.

Kids these days. Do a shitty job of report writing, and then cry when you don't get what you want.

He's a passenger in a vehicle owned by another. The fact he is a convicted felon has no bearing on his knowledge of what is in the glove box.
That's the law.
As a police officer you know as well as I do that he put that gun in the glove box when the traffic stop was initiated.
But it's not what you know but what you can prove.

I have shared this on Facebook and contacted several local and state politicians regarding this bullshit. When asked I will tell them the source which is your thoughtful website. Fucked up that the major news organizations with their highly paid staff cannot or they refuse to come up with street level stories like this. Instead we get Pam Zekman bitching about parking spots or Chuck Goudie talking about mobsters or the dude on Channel 7 discussing microwave ovens burning. This is a real fucking public safety issue. How the fuck can you just walk away and there is a loaded gun in the car, illegal, you are a fucking felon with a massive background, several of which are probation violations? Geezus. Shooting at F&J Roadhouse
Three people were shot inside a bar in Stickney Township in unincorporated Cook County early Friday, authorities said.

The victims were taken to area hospitals, where their conditions were stabilized, said Cara Smith, a spokeswoman for the Cook County Sheriff's Office.

Deputies responded about 2:10 a.m. to the bar in the 5000 block of South Central Avenue, which is about two miles northwest of Chicago Midway International Airport.

A woman waiting at a gas station one street over from the bar, the closest deputies would let her get to the scene, said she came to make sure her friend who waitresses at the bar was not hurt.

Her friend was not injured but "freaking out," and crying hysterically while on the phone, said the friend, who asked not to be identified.

Another man rode up to the gas station on a motorcycle to check on some friends who may have been at the shooting.

"Everyone knows this is a Latin Kings bar," he said on the phone.

This reminds me of an incident were we had a rash of stolen vehicles that were being stolen using tow tucks. Partner and I observe a tow truck pull up to a car parked legally and proceed to take it. Talk to owner of vehicle who related that her vehicle should be parked on street and no one was authorized to be in possession of her vehicle. She never ordered a tow on her vehicle. Contacted states attorneys office, charges denied due to the fact that the tow truck driver stated he recieved a call from a person to tow the vehicle even though the tow truck driver didn't have any paper work, didn't know the owner, didn't have the plate information nor the vin..You gotta love Chi-Raq and Crook County... police are handcuffed, criminals running wild, and taxes after taxes...

Talk to any ASA anywhere in the State's Attorney's Office. They are miserable with Kim Foxx and her new people. Her top people have zero experience in the State's Attorney's Office. One of her top people Katie Hill worked at Loevy & Loevy. They are all going fetal now too. Any on of them will tell you that they are just trying to keep their head down until they have their time or they find a new job. Cook County does not have a prosecutor now - just a second public defender who calls herself Madam State's Attorney. Sad. Very sad.

To the super cop working VRI in 011. If you want to make comments about things, you should probably try to concern yourself with things like facts. Facts such as, 1 of the 2 Sgts ON SCENE was the only one who was struck while in his squad. The offender then hit another unoccupied squad while fleeing, with those officers keeping themselves out of harms way. Hell, I wasn't there either, but i managed to get the story right by listening to the zone and then asking a few people, instead of just making wild assumptions to post bullshit. You seem to be the one with your head up your ass. I don't know any of those involved, but from what i gathered, i have no problem with how it went down. Ignorant and judgmental coppers like you are a cancer to this dept, killing us from the inside when we already have enough shit to deal with from everywhere else.

You think this is bad. Ask people who work in Sheriff Tom Dart's Electronic Monitoring division. My department arrested a guy about two months ago for DUI wearing a Sheriff E.M bracelet. He was armed habitual criminal with a juvenile murder conviction only 7 years prior. He was wearing a Sheriff's E.M bracelet for current drug dealing charges. We contacted Sheriff's E.M division and they refused to get him saying he wasn't a priority. The guy basically told us they were swamped with violation cases and they would "catch up with him later". He said the Sheriff's office does NOT consider prior records and the drug dealing was not considered a priority case. Why is Chuck Ghoudie or Pam Zeckmam not investigating the Sheriff's obviously flawed E.M program

This is the problem with the lack of training on this department. Any officer that is experienced in making UUW arrest would know that this wasn't going anywhere as soon as he saw that he was a passenger in a car which the weapon was found in a glove box. You can't prove he "knowingly" knew it was in there. Sorry to be a party pooper but the ASA's are right on this one.

While I have little doubt he knew about the gun, how do you prove that beyond a reasonable doubt given that he was a passenger in another's car? I have people ride in my car all the time who have no idea what is in my glove box. Were the guy's prints found on the gun?

Sounds like a whiny suburban cop who doesn't know what it takes to prove a case in court. KNOWLEDGE that the gun was there. He's not the driver, he's not alone in the car, it's not his car, the gun is not in plain view which would put him on notice that its there and he didn't admit to knowing it was there, nor did a witness say it was his gun or that they saw him put the gun in the glove box. Knowing or believing he put the gun in the glove box versus proving it are two completely different things. This is coming from about as big a fan of law enforcement as you'll ever meet. Very unprofessional way to write a report.

So many of these posts reveal how clueless many POs are when it comes to the law. The arresting officer absolutely established probable cause for the UUW arrest for any and all occupants of that vehicle, especially the arrestee. Go read the statute and hopefully those who doubted the a/o will realize that he was correct. The fact that the ASA doesn't like approving the UUW charge against all occupants is simply their way of exercising their discretion on who to prosecute, and doesn't mean there is no probable cause to arrest and charge anyone in that vehicle. The fact that the ASA chose to reject charges based on the arrestee's word is appalling and there should be total outrage from Eddie Johnson. That he is silent is the saddest part of this entire ordeal. Terrible leadership but no backlash because the aldermen are satisfied the superintendent is black. McCarthy, who I didn't like, would've faced so much more scrutiny simply because he is a different color than the Black Caucus. We live in an age where diversity is forced on all as a good thing, when all it is is code for discrimination against straight white men. With Rahmbo, Foxx, Johnson, Dart and Preckwinkle running the show this whole place is a lost cause.

In court this would be a shit case. It should not even pass a probable cause hearing. It is what we can prove that counts. The only thing we can PROVE based on this narrative is that there is a gun in glove box.
If you give them something else you may have something. For example: "as R/O approached, he observed the subject put an object in the glove box. Upon inspection R/O found a gun."

How did he manage to hit three squad cars? Was the chase started before or after the cars were hit? How did three separate cars end up in the path of the fleeing vehicle in order to get hit? What was the jeep being chased for in the first place? What was said over the air by the chase car? You're leaving A LOT out and putting a whole lot of blame on the sergeant. Perhaps the people chasing should pull their heads out of their asses or get out of eleven. Some people never learn. Let's just continue all chases that never should have started so even more police officers can get injured over some bullshit. Three police vehicles don't get hit in a chase that conforms to policy. I'm sure the chase car should have self-terminated before any sergeant had to do it for them. So, were any cops injured?

This incident needs some clarification:

1. This was NOT a CPD arrest. This was in Riverside BY Riverside PD.
2. To the posts who claim that the "report writing" is bad, this was only entered into ICLEAR for documentation/tracking purposes. Hence why the narrative is so short and direct. Outside agencies use their own systems, reports etc. They enter their arrests into ICLEAR for our benefit.
3. Yes the fact that Kimiesha's office didn't approve charges is BS.

So something isn't right with the actual charge either.
So there's not much other than a highlighted portion of an arrest profile narrative.
And then, in this day and age the only penalty here is someone is going to take heat for the insensitive narrative.

Although one thing comes to mind is that how the entire Stop came to be, how it was worded in the GOCR, how it was articulated in to the ASA, And IF by the Area.
Stupidity on the part of the Office of the Sates Attorney never ceases to fail when every t is cross and every i is dotted.

BUT - is this just a case where an "impatient, waiting for hours for the Area, wanting to go home", PO calledthe ASA for approval?
Because there are some points that are unclear and comments should be taken for what it's worth.
First, It's not a deal breaker to handle Felony Review by a PO, but you have to be on the same page as them and how you relate the details.
Hope a lesson was learned...not all ASA's are alike, such as the last one who approved your similar 2016 case.

So, the Offender was just a idle Passenger sitting behind a concealed loaded firearm, chilled out on a bit of blunt a hour ago and was just getting a ride home...blah-blah-blah never heard that before.
But what about the Driver (DUI or uncharged?), he would still have direct access to a glove box firearm and is always charged when alone, not necessarily a Passenger. I'm thinking the Driver was first to say - It ain't mines ...hmmm?
Was the ASA fixated about "ownership" or access (which obviously they both had) ?
So neither the Driver or Passenger doesn't know ownership, but nobody can decide who has the access?
Yes, most easily accessed by the Passenger but that avenue failed firstly or secondly?
Ok, so the Passenger says it's not his gun, but what about the Drivers story?
Was it his registered car?
What the A/O told (in so many words), to the ASA is key to why Approval was denied.
Since there no ETs either, PO's have to refrain when possible from handling recovered firearms without the use gloves and firearm envelopes, another ASA stickler besides cameras and third party witnesses.

By the way, where was the arrest, 7200 W. Cermak or at home 3900 N. Normandy?
A small pimpy detail that will shitcan in court and lead to false arrest.

Beware - It's best to get you and all the helping hand assisting PO's on the same page before calling a Cook Co ASA.
Too many cooks and add-ons, PLUS going home early without Det interviews lead to Holds and eventual Denials.
Those one PO interviews and six on the paper are a thing of the past.
Where was the shorthanded, shooting scene and overwhelmed Detective Area anyway?
Did anyone bother to call for some direction or ask the DSS?

Those two lifelong illegal 025 gangbanging thug residents should have been locked up...both of them.
When every level of the ASA responsibility fails, a simple notification to ICE should always be an alternative.

Thanks for the law but you just proved everyone else's point... dumb dumb should have arrested the driver, not the passenger who denied all knowledge of it. Or you take the gun for prints and impound the car. Wait 8 months to a year to get prints of any and charge accordingly then... this is 2017, the only way to do it and the proper way now. Passenger has a hell of a lawsuit, it's not closest one to the gun with the worst record gets it. The narrative is asinine.

Of the over then 100 guns which I've asked to be printed I've only had 1 come back with useable prints.

Was it his vehicle? Did the officer observe him place the firearm in the glove box? The law is not proximity to the weapon, but needs to exercise actual control or at least constructive control of it. What if my neighbor gave me a ride in his car, we get pulled over and there is a piece in the car? Am I guilty?

The officers need some guidance on his paper too. CMON white shirt thats why you check the reports and recieve extra pay each day too.

Dog??? Hahaha, I don't think so pal. But I do have enough experience on the street and in court to know that this case cannot be charged as written. If you are gonna write it like this then impounding the car and printing the gun is the only way to go. Or you take the driver and hope to get a statement, or take the passenger but if you do then you have to make sure you are willing to play the game like back in the day, if you play the game then charges approved, but like I said this is 2017. Learn the law u dummy, this case cannot be charged as written. The copper tried being cute and was bitter it didn't get charged but wasn't willing to go all the way with it. If you want it that bad then you need to know what you are doing and how to play the game and be willing to go through with it 100 percent. This guy who wrote it has none of the above. Stupid in my opinion and inexperienced in what to do.

Bingo! That is why the academy is there to help with questions and training. Do not be afraid to get help. It will not make you less of a person to admit that you need extra training or do not understand how to make an arrest.

Funny narrative, but no where close to having the PC to charge the passenger. Cmon office, just because the glove box is closest to the passenger doesn't make it his; in court anyway.

You clearly lacked the experience to know that what he wrote, ISN'T the actual narrative, ISN'T the full report, DOESN'T say everything that happened and that surburban departments use Iclear to input their arrests with a small summary. I won't argue that what he wrote was meant to be cute and sarcastic. It'll look terrible in court, absolutely. There is more to this arrest, however, than the little quip he put.

Back in the day like 25 years ago.

We found one gun under drivers seat during street stop.

ASA approved all charges for all four occupants.

No one admitted to who was in possession so all four were charged and when it went to court 3 were violated under parole and the forth was a juvenile....

We hold fond memories for the last of the "Golden Time"
to be The Police.

We knew the end was nigh about 20 years ago when we
curbed a vehicle matching the description of one such
where automatic fire emanated from.

The designated runner (front passenger) bolted...
We froze the other three occupants.
Called it in, got help on the scene
and got the three assholes out and
lo/behold there was a Tech-9 wedged
butt-up between the driver and passenger's
seat.

Simple.
Right?

No bullshit. No creative writing.
No inventing fez-wearing mystery men
zooming in on magic carpets or any other
improbable/unlikely shit guys have been
known to include to make their paper "tight."
