ACLU "Blindsided" by Fardon

Well, we can pretty much assume that Fardon kept his mouth shut and prosecutors out of City Hall because he knew he'd make his masters unhappy if he got too nosey. His exit letter was amusing as hell though:
  • The American Civil Liberties Union on Tuesday blasted former U.S. Attorney Zachary Fardon for what it characterized as a "blindsided attack" on a 2015 agreement curtailing the Chicago Police Department's use of stop-and-frisk measures.

    In an open letter released to the media after he left office Monday, Fardon said the ACLU's settlement had "swung the pendulum hard" away from pro-active law enforcement by "telling cops if you go talk to those kids on the corner, you're going to have to take 40 minutes to fill out a form, and you're going to have to give them a receipt with your badge number on it."

    Fardon said the new procedures for street stops, as Chicago police call them, were a key reason for the spike in violence that began in early 2016 and had a chilling effect on many police officers who "no longer wanted to wear the risk of stopping suspects."
No shit? Isn't that what we have been saying for over a year now? And our readers? And the unions? And anyone with half a fucking brain?

The ACLU was none too pleased:
  • In response Tuesday, Karen Sheley, the police practices director for the ACLU of Illinois, said Fardon's opinions were out of line with the Justice Department's own investigation that found widespread constitutional abuses of citizens, particularly in low-income minority neighborhoods where the majority of street stops occur.

    Fardon also "wildly exaggerated" the time needed to fill out the form and ignored "the real impact and harm of these stops," which occurred far too often and under suspect or unconstitutional circumstances, Sheley said in an emailed statement.
This from someone who never filled out a card - obviously. And who actually has the audacity to claim the DOJ report, which was written by ACLU flunkies, matches the ACLU findings for some odd reason.

The "real impact and harm" rings hollow in the face of nearly 800 murders and over 4,000 maimings - actual harm as opposed to a minor inconvenience. If documentation was better, we'd bet that fully half of the "unconstitutional" stops would fall within Constitutional limitations. ISP and numerous suburban departments seem to do fine with an Investigatory Stop Report that is similar to our old Contact Card, without 76 boxes to fill out. How many of them are under Federal Consent Decrees again? None? Wow.

Ummmmm....yes the form does take a real long time and and even longer if you pat the person down or search their effects. Also we can't do the form in our squad cars cause the computer doesn't work properly to do it and it's awkward and difficult to do in the car. So now we're taken off the streets to use the computer in the station just to do some silly worthless report. How sad. The ACLU and politicians killed policing. Farden is right and a hell of a lot smarter than these ACLU hacks

Well one person you can thank or hold responsible, depending which side of the fence you're on, for the 76 boxes is none other than the defender of the working people, Dean Angelo. Neither he nor anyone else from Lodge 7 challenged this crap down in Springfield.

Kevin Graham, who was on the Lodge 7 Legislative Committee, challenged Dean and his lobbyist to draft legislation to include a sunset provision to end this crap after twelve months. The lobbyist pitched a proverbial bitch telling Graham that it would make Dean and the lobbyist look stupid as they had already agreed to the legislation. Graham persisted in his argument and twenty four hours later Graham was summarily dismissed from the committee.

Agreed to the legislation? Why would you vote for anyone else?

Street stops didn't stop crime. Citizens calling the cops for break-in, vandalism and theft is what lower the crime rates. Burglaries and vandalism is not called in because they know the cops can't do anything to get their property back and sometimes responding cops are rude and make you wish you never called. After I moved from the Tenth District crime shot up because they knew no one would complain to the cops and crime has skyrocketed. CAPS does work if people would say something if they see something and it is obvious they don't.

I guess I wont't make any money on this idea, here me out....WIth no contact cards, detectives have one less important data base to solve crimes. P.O.s want to be very sure not to violate any one's civil rights with regards to a stop. I propose in addition to a street stop when necessary, do an observation card. Say you see the known gang banger on the such in such corner but don't have R.A.S. to stop....do an "observation card"...document his/her identity, location, time and attire without any punitive consequences....For the good of the department.

I believe that Patrick Fitzgerald, former Illinois US Atty got fed up with all the control from the Obama White House on who and who not to investigate and merely stepped down in order to not further tolerate the conditions.
It was the same way for our former Chicago Fire Commissioner who had Rham up his butt about staffing and other CFD conditions. While he indicated he was stepping down from his (very respected and dedicated) fire service to spend more time with his family, he took another (outside agency) fire Comish job within a month of leaving CFD.
I believe Fardon and/or his predecessor could have easily made a case(s)(ala Blago) on shortshanks, Madigan, Rham, Jesse Sr., Lil' Louie, Bobby Rush or their ilk but were told to lay off.
Let's hope the new US Atty for Northern Illinois has a free hand in investigating and sending the appropriate people to federal incarceration.
One could only hope.

Well it looks like the chickens have come home to roost. The title of the letter should be United states attorney from Chicagoland finally unleashed telling the truth under Obama things were kept quiet to pander to the community of criminality. Fardon has hit the proverbial nail on the head this is what the Trump administration is preaching currently law and order the ACLU is like a pimple on the ass of an elephant verses The United States attorney I guess he was a good guy all along but he was restrained by the former Democratic administration which would not allow him to do his job properly and allow him to publicly support the Chicago Police Department to protect the citizens of the city of Chicago the county of cook the state of Illinois.

Policing all over the country has changed dramatically especially here in the city of Chicago the bloodshed the carnage this is all attributed to and lays directly at the feet of the elected especially the mayor Tony Tommy and Bruce plus the 50 so call alderman and the other elected officials throughout the state what is Lisa Madigan done in her role as the state of Illinois Attorney General to help quell the outbreak of criminal activity throughout the city and pretty much throughout the state nothing that is the answer! Police officers in the city especially have been bastardized the 24 hour a day seven days a week dishonest media is constantly attacking the police officers just read the Chicago Sun-Times or the Chicago tribune newspaper's seems like every day multiple negative stories on police officers from the city of Chicago anything that they can find no matter how small how trivial they will enhance it and put it out there. At one time in the city we had real investigative reporting that is going by the wayside they are all left the dogs to the elected they are told what to report and what they will not report they put their heads down listen and do as they are told we have no independent reporting any more again the city of Chicago with all the corruption in crime controls the narrative of the media.

Police officers now thanks to all of this is phony consent Decree etc are in self preservation mode this is just like anyone else that works in corporate America when they are being thrown under the bus and you're worried about your family your career and even your very freedom you have to be in self-preservation mode anyone or disagrees with that is insane. Our own police commander's exempt ranks have no clue how to be the police much less how to back the troops we have way too many in the command structure or they're only not because of competence but because they are clout people never paying their dues just there to get the big punch in depth and another six-figure job when they retire. On that note what is going on Kenny with the gold braid elimination bill like the fire department has done how far is that progress is it out of Committee yet? This is nothing but drawn down our pension benefits that are funded worst in the nation and only 25% as the city made the proper contribution pension board crickets ?

To the clown claiming that street stops didn't stop crime and CAPS does, please tell me you're not a cop. CAPS is a fucking joke and for decades has been nothing more than an inside spot for those in fear of working the street or the clouted. I will admit that there are indeed some beneficial programs within CAPS, but for the most part they just give away free shit and host parties with no effect on lowering crime whatsoever. It has been mentioned here on SCC countless times, street stops are and were a major deterrent of crime for the simple fact that it kept these jagoffs in check. Even the idea of possibly being stopped by the police might make a gun toter think twice about carrying that gun, now that same gun toter carries that same gun freely knowing his chances of being stopped have plummeted. Even as recent as a few years ago when groups of thugs were street stopped the sheer prevalence of armed offenders was not even close to where it is today. These guys simply know they won't be stopped , not only from them hearing and seeing it everyday on the street, but the media saying it over and over. Unfortunately CAPS is part of this new regime, but please don't sell your bullshit here that it stops crime.

You know what stops the crime, ability for police being the police.
If your citizens tell you who committed the crime you still need to go investigate it, stop the subject and fill out ISR, and most likely take a risk being sued after for violating the suspect's rights.

I just read Fardon's 'F--k You' exit letter. His 'Five Points', while pretty good IMHO, it misses on a couple issues.

--- 1) His Fifth and final Point. The Bail System in Cook County
I understand his frustration how Gangbangers get Bail with a Cash Bond seemingly no matter how high while 'poor' suspects stay locked up. But his No Bail for 'repeat gun offenders' gets pretty close to to violating the Eight Amendment's no Excessive Bail clause (No Bail at all is sort of 'Excessive'). And scumbags these people, and folk, might be, they're still suspects, not convicted of the crime at hand. It also seems to violate the Writ of Habeas Corpus clause as per Article II, Section Nine, Paragraph 2 of the constitution.
------ 1a) What Fardon *should* have ranted about was the goofy, inept, Criminal Friendly, judges in Cook County who hand out insanely lenient sentences for repeat gun offenders. And the Parole Board morons who let the animals who do get convicted and sent away out of their cages when they're still a clear and present danger to society.

--- 2) His Third Point. The Social Media.
He admits there's a First Amendment issue with trying to censor the Gangbanger's postings of threats and violence and he's right. There's no way for social media in the USA to completely censor this crap. Blocking certain words would be about the best you can hope for. Even then, Lawsuits would be filed by the ACLU claiming discrimination against minorities faster than the speed of light.

I do like his idea of a Federal Task Force. Combine the DEA, ATF, and FBI and turn them loose on the gangs. But overcoming Turf Wars between agencies could be an issue. Bottom line, at least Fardon had the balls to speak out and give some ideas on his way out. That's not seen in today's 'cover your ass' political climate.

One last thing -- Why is it that NOBODY mentions Project Exile as a tool to fight gangs? Could that be because the NRA was involved in its inception? I think so.

Rebut the 76 box contact card with demanding a warrant instead. Make those "above" you ( you know those black robed kings who are so favorable to yer buddies at the ACLU) face a unending string of calls and visits and what would end up being literally endless pestering for warrants for everything from the murderer you suspect to that thief and their fence you know are operating almost as openly as Rahm and Company too too productions.

The endless paperwork is actually their responsibility, and they are putting it on you cops! They are basically shoving their job - and their responsibility, on to you so that they are not the ones left holding the bag.

Face it guys and gals, that command for a warrant was crafted just as much to protect YOU on your job as it was to protect the average joe six pack walking down the street. Stop being conned into playing the ACLU's patsy. Stop playing trickster and stop playing games. Of course you have to have the authority (just like anyone else) to act in the moment to stop a violent crime, a real violent crime not a fake one, in the moment. But just stopping and frisking whoever you want to and THEN filling out some card about it is a JOKE, a bad joke. It is exactly backwards! First you get the paper - THEN you get it SIGNED by a judge, THEN you go arrest. Only then will YOU be protected, rights be protected and then JUDGES he left holding the bag of responsibility. Yes, the means matter just as much as the ends, unless of course you really want to take this to its logical endgame - central planning, where rights are ignored and everyone really is deemed guilty until proven innocent. Do please keep in mind......as the ACLU is SHOWING YOU, that you cops are not EXEMPT. Yeah, you are being tossed under the bus in a New York Minute as guilty until proven innocent too........and they are setting up the courts to work AGAINST you before you even walk in the door. How does it fell to join our club, huh? Not so good? Imagine that. Guess what - some of us who are not guilty of any crimes whatsoever have been treated by YOU GUYS the way YOU are being treated by the ACLU and the corrupt judges right about now. Here this POS collects a fat pay check for years while under the Obama administration. He is the highest level of law enforcement in Chicago area. He's the top dog people. He keeps his mouth shut while the city of Chicago and the Chicago police department is destroyed about this issue...Think about it, did he try to change the format,implementation, procedure? Did he weigh in and say it was a bad idea.......NNNNOOOOOOO he didn't. Now he writes this letter on the way out.

Please......., go suck on the tit of a high priced law firm and file suits against police for wrongful acts judged in a 2 year optic that took 2 seconds on the street in real time.

One can only hope that Karen Sheley, the police practices director for the ACLU of Illinois, needs the help of a police officer and they are too busy filling out the forms she says don't take that long. Her and the rest of the aclu (always creating law unenforcement) with everything they touch. Well now their voice for the few has impacted the many, and those few they protect are the ones that threaten us all.
Good job aclu. Definitely not what TRUMP has in mind to make America GREAT again!

The Anarchist Criminal Liberation Union needs to be held responsible for inciting violence.
They need to have a few of their followers become statistical victims on the streets of Rahm's Chicago and elsewhere.

Yes....Fardon would have been shown the door by Eric and Barrack....but he could have held his head High as he walked out the door. This is just a parting shot to try to show that "he didn't agree with this shit when it was happening."


That is no better than all the people that willingly worked the Security Details for Daley or Rahm for a bigger paycheck.

Stay fetal guys, if you notice a coworker going out of their way to make an arrest or stop card, have a conversation with them. We all need to be on the same page, especially with the hot summer coming up. The only power we have is if we stick together and not do anything except respond to calls for service. Even with calls for service, provide the least amount of service as possible. Veteran officers, do your part and get into the ears of the young officers, tell them to chill the f*** out and stay fetal. Remind them that there is a bigger picture and we are under attack by the liberal politicians and media.

Fardon was put in by obama and told to lay off Rahm and the democrats. He didn't come close to any of them. Rahm, Reilly, madigan, the black caucus and Patricia van pelt along with Rush have slid because of obama. What's more sad is that the acting us attorney Joel levin who came out of Perkins Coie has given 33 campaign contributions to all dem and progressive causes including money to Rahm Emanuel in 2016. How is this not an illegal conflict of interest?

Sorry being late to the party SCC.
But I think you should make this a point from here on out when this topic comes up.

The old contact card system was fine.
Our understanding of the use of the system was fine.
The documenting of our reasonable suspicion was fine (accept for the foot patrol kids, to no fault of their own)

However, what made us fall into this ACLU report was MANAGEMENT!
The mayor, the Supe, commanders and all the way down the line to the sgts are all at fault.
They were the ones that demanded MORE OR ELSE!
The city and department, in violation of the federal quota laws, said that if you want overtime you have to bring in numbers.
If you wanted to work a beat because you got to know the area and the players (criminals) you have to bring in numbers.
If you want to work with someone you gel with, bring in them numbers.
If you don't like working with the nuts, drunks, or creeps, bring in those numbers!

And even after the Feds came here and "investigated" the department, no mention of this was made. I'm sure we said something to them about this. But where is it in their report?

If the aclu really wants someone to hang someone they should have started with the command staff, not us.
