Taser Restrictions

Remember all those Tasers were supposed to get? The ones that will provide certain connected folks a big boost in their bank accounts? Yeah, everyone might want to read the linked article here:
  • Police officers lacked clear legal guidance on when they may zap people with Tasers, the 4th Circuit Court of Appeals decided on Monday, so it made a new rule to restrict their use.

    If a person is not creating "an immediate safety risk," the court said, officers aren't allowed to shock him with a Taser. The pain it causes is an excessive use of force that violates the person's constitutional rights under the 4th Amendment, it said.

    The ruling arose from a lawsuit against Pinehurst over the death of a mentally ill man. Pinehurst police used a Taser's pain mode in a failed attempt to make the man let go of a post. He died a few minutes later.

    The decision applies in the five states in the 4th Circuit: North Carolina, South Carolina, Maryland, Virginia and West Virginia. The N.C. Justice Academy advised law enforcement agencies to revise their Taser policies to comply.
It's a Fourth Circuit decision, but federal courts have a habit of looking at what each court is doing before deciding which way the wind blows. And the Fourth Circuit encompasses the DC metro area where a lot of congress-critters spend time and decide the rules that lesser mortals must follow.

Predictably, police will probably revert to other methods from years gone by:
  • Officers likely will resort to other weapons, like pepper spray and batons, plus hands-on techniques to make people comply with their orders, said Cumberland County Sheriff's Office attorney Ronnie Mitchell.

    "I'm afraid it will lead to more injuries to individuals," Mitchell said, both law enforcement officers and the people they are attempting to detain or control.
No kidding. We wonder if Rahm has seen this decision yet...or DeEscalante with his "Force Mitigation" bullshit.

If someone is an "immediate safety risk," we aren't choosing to use a device that has a failure rate approaching the graduation numbers for a Chicago Public High School. We're choosing something that will let us go home at the end of the tour.

Can someone please answer this? Can the department force us to carry a tazer, a weapon? I understand we have to carry a gun of course, but what about secondary weapons? I've never used or carried a tazer and don't plan to unless the dept forces me. I personally see it as an unnecessary, cumbersome piece of equipment that I will be accountable for if damaged or lost. It's also another weapon I must be cognizant about while working and another weapon to which I must maintain retention. Before they came around, the dept managed to survive a very long time without them. It should be the officer's choice to carry one.

Having carried and used a Taser, I can tell you if the offender is wearing a sweatshirt or light jacket, the failure rate will be 75% to 90% of the time, because the taser darts wont penetrate the clothing enough to deliver a sufficient electrical charge to incapacitate the person. If the offender is wearing a medium to heavy coat, the taser will not stop him. With Chicago weather, how often are people wearing jackets and coats? The FOP really needs to speak out on this before a copper gets hurt or killed trying to be politicaly correct to appease the cop-hating big mouths all in the news lately. The union should contact the taser companies. They will send out expert witnesses to give advice for any policy making committee or whatever, and hopefully, keep the policy realistic, instead of the nonsense of the politically correct fantasy world.

Sad part is I have seen a persons hand crushed by the swift strike of the asp. But if the courts make laws now then I guess it is OK.

Not a fan of pepper spray it always seems more officer get sprayed with the pesky musk.

The problem here is "Appearance" and "Perception". We live in a Society and time where people are either too busy or just don't care to go beyond what is visible. Using force to a level that will induce submission is never an attractive sight. So officers will have to wrestle, and use striking blows to various parts of a citizen's body to produce submission to arrest or control. Everyone of these incidents when viewed on tape will demands by the blow. Just as in shooting where we see demands of a million dollars for each round that struck, "Ma Baby". We will see bottom feeder attorneys demanding dollar amounts for each blow. Baby"G"

This was in the news over 2 weeks ago.

By 1 June 2016 all personal who are on the streets are to be trained and CARRY the Taser.

The orders are being rewritten and they are figuring out how to get thousands trained for the 8 hour class.

Realistically, it will not happen by 1 June. Perhaps early fall.

Why are you so concerned about what others are doing and not doing? You should worry about yourself. Last night we had three major foot chases. I heard what the dogs/people like you were griping about- "oh they don't get it", "they are idiots", etc. Some people like to work. So they will work. Nothing wrong with that.

In order to qualify to carry the taser, I think you have to take a hit yourself. I am concerned because I have heart rhythm issues for which I take medication but am still able to fully function. Would I be exempt?

Was at the dog-and-pony show at the Hideout Bar where Carol Moron and Ahern were. They both should have stayed as English teachers.

The issues of TASERS was brought up. Seems the media is gaga over these devices as magic wands that will eliminate deadly force by police.

Police know differently.

#1: The recommended safe minimum distance for someone with a knife (20 feet) is the edge of the effective range of a TASER.

#2 TASER is not 100% sure thing. (Barbs don't lodge, clothing insulates, drugs in body dampen effect)

#3: If TASER fails, no follow-up shot unless there is a 2nd TASER on scene.

#4: There will be accidents like those that occurred in New Mexico(?) and San Fran where a PO under high stress inadvertently draws and uses his firearm when he meant to get the TASER and kills the subject. One is in prison, the other may be going there.

Couldn't agree more. My last two years on the job, with an expired taser certification, I didn't pursue renewing it. I felt the liability of carrying or using the taser wasn't worth it. Somehow, I managed just fine for 27yrs without one.

I think all cars should be equipped with an expandable 10 foot pole with large feather attached at one end.
We can call it the "tickler", it would subdue assailants by tickling them into submission. This tool would replace our service pistols. No more pesky firearms quals every year or there being a chance of us shooting someone. For our protection we would have to check out a shield at the radio room to be used in case of being attacked or shot at only. Also no more physical stuff of any sort at the academy. All new recruits will spend the six months or so trained entirely on the e learning system. No more taking chances of anyone possibly getting injured or hurt even remotely during police encounters or training.

that about sums it up.. I think this is the police force they've been asking for. We just haven't been listening.....

Brilliant work by people who are out of touch with reality. The taser causes pain only during the time in which the current is being applied. To remove that as an option, in favor of going hands on, swinging a baton, tackling, etc., is undoubtedly going to cause more injuries, and more serious, and lasting, possibly permanent injuries. If a taser is excessive force, ANY other force, other than OC, would be excessive as well, since every other option causes more potential for injury than a taser would. If I were so inclined as to commit a crime and resist being arrested, I'd prefer a quick jolt from a taser over a pummeling or baton strikes. I'm sure many others would agree. Complete disconnect from anything even resembling reality. Fucking morons.

A little off topic. I remember going to those DOC meetings and having Phil and Molloy and the rest of the clowns constantly badgering people about contact cards. So, the pressure was on for numbers. Now, it has turned around and bit the department in the ass. Amusing.

Yup, activity requirement to qualify for VRI sure sounds like a quota to me. Gee I wonder why the performance recognition system is being moved to crystal reports? New way to check your "VRI quotactivity".

I've never used or carried a tazer and don't plan to unless the dept forces me. I personally see it as an unnecessary, cumbersome piece of equipment that I will be accountable for if damaged or lost. It's also another weapon I must be cognizant about while working and another weapon to which I must maintain retention. Before they came around, the dept managed to survive a very long time without them. It should be the officer's choice to carry one.

Couldn't agree more. My last two years on the job, with an expired taser certification, I didn't pursue renewing it. I felt the liability of carrying or using the taser wasn't worth it. Somehow, I managed just fine for 27yrs without one.

Why ANYONE would want to go hands on with a crazed, mentally ill or controlled substance fueled psycho without a taser is just beyond me. I too spent most of my career managing to deal with the above described crazies without one. I was very fortunate; I've known co-workers who have had to undergo painful rotator cuff, ACL and torn meniscus surgeries because they weren't able to manage or subdue some jacked up lunatic resister. If you want to end your careers with such injuries, that's on you. Anything the increases the chances that I will return home after my shift on a daily basis without those kinds of injuries I want to have at my side on a regular basis. It's a no-brainer, Francis.

Take a close look at (720 ILCS 5/Art. 7)
ARTICLE 7. JUSTIFIABLE USE OF FORCE; EXONERATION

(720 ILCS 5/7-1)
Sec. 7-1. Use of force in defense of person.

and

(720 ILCS 5/7-2) (from Ch. 38, par. 7-2)
Sec. 7-2. Use of force in defense of dwelling.

and

(720 ILCS 5/7-3) (from Ch. 38, par. 7-3)
Sec. 7-3. Use of force in defense of other property.

and

Here is the key paragraph found in 7-1, 7-2, and 7-3. Not only is their protection from criminal liability but for civil liability as well.

(b) In no case shall any act involving the use of force justified under this Section give rise to any claim or liability brought by or on behalf of any person acting within the definition of "aggressor" set forth in Section 7-4 of this Article, or the estate, spouse, or other family member of such a person, against the person or estate of the person using such justified force, unless the use of force involves willful or wanton misconduct.

Please go read the applicable law yourself. It is pretty clear. Read section 7-4 too.

The current leadership at the academy shares your ideas. He believes that discipline does not have a part in training. He lowered physical training standards and raised academic standards. Smarter recruits that are out of shape that lack the physical skills ta take a suspect into custody. They want to remove discipline. Unbelievable.

The easy answer to this is simple. If you are not going to carry a taser, do not call someone who does to come over and accept the liability for you on your scene. Police work was handled before the days of tasers. If you want to go up without one because it is more comfortable to not have the extra belt accessory or you prefer someone else to take the lawsuit when you call them over to zap your guy, then learn to handle your calls the old way without a taser. There is a difference between being someones backup and being someones chump. If you have enough time to ask for a taser and for it to get there (obviously these are not 10-1s), you have plenty of time to figure out your own situation and utilize the tools you did choose to carry that day.

What other officers are doing affects every last one of us, you clueless motherfucker. I'd love to hear the outcome of these "major foot chases," whatever the fuck that means. What amazing felony charges were approved on these offenders? What was the reasonable articulable suspicion that caused the go-getters to initiate the foot chase? Did they rifle through the pockets of the offenders looking for a reason to arrest them after the chase? Did anyone get a bonus kick or punch in on any of the offenders? Were any officers injured as a result of the chases? Were TRRs completed? Did the offenders go to the hospital or get treated by CFD? Were any offenders charged with reckless conduct because they happened to run into the street during the chase? Answer those questions, and then ask yourself how all of that nonsense could possibly lead to multiple lawsuits, officers on trial, etc. It's a new world, you clueless moron. Wake the fuck up and realize what's happening to us. Protect yourself and your fellow officers by not engaging in activities that put us all at risk.

One forty-five pm, you're overlooking the possibility that the person not carrying a taser can't get in to qualify or there aren't enough functional tasers available for everyone who's qualified to sign one out.

At this point, if you have not qualified to use a taser, it is by actively avoiding it along with recertification . The number available? I'll concede that it may be an issue in some places. But even in those places, people are passing on carrying them because they would rather call someone else to take on the liability and call them over to the scene if needed.
