FOP Wins a Big Victory

  • A labor arbitrator has said the city must destroy Chicago police disciplinary records dating back decades, the latest blow to activists’ attempts to get access to misconduct files from as far back as the late 1960s.

    A ruling issued Tuesday in a labor grievance case between the city and the Fraternal Order of Police states the city’s contract with its largest police union requires it to destroy most disciplinary records four years after complaints are filed.

    Arbitrator George Roumell Jr. ordered the city to begin negotiations with the FOP on which records were due for destruction — files in pending lawsuits would be exempted — and said he would issue a final order in mid-April.
The usual persons are upset:
  • Monday, State Rep. La Shawn Ford, D-Chicago, said he planned to introduce legislation that would require police departments across the state to keep all disciplinary files permanently, a move he said would pre-empt any union contract.
Hey Ford, why not work on trying to pass a budget? And leave local matters to local authorities?
  • Craig Futterman, a University of Chicago Law School professor who has joined litigation seeking to make the decades of disciplinary records public, said Friday he was concerned that the ruling leaves just a few months before a court-ordered “bonfire” of data that could be used as the Chicago Police Department makes reforms in the aftermath of the Laquan McDonald shooting and a looming federal investigation of the department.
A "bonfire" decades in the making:
  • City officials have testified they maintain more than 3,600 boxes of investigative files and several computer databases, holding police disciplinary records dating back to 1967.
Fully 60% (or more) of the Department wasn't even born in 1967. Yet these files exist in violation of numerous contractual agreements, thru assorted political administrations and not a few FOP regimes. We wonder if some sanctions might be assessed against the City at some point.

The court got it right. There is absolutely no reasonable purpose to releasing these decades of files in violation of the contract except for those looking to troll the police and play Monday Morning Quarterback.

why so many boxes. You can scan and put on a few hard drives to save the space. Or are they at a connected storage facility run by Vanecko investments and realty, rented to the city and paid for with police pension money, WTF.

Aside from the usual drivel that I hear on daily media beat downs and politicians that now refer to police officers as corrupt and the entire department as a scandal. I ask what percentage of alderman, state reps, governors, mayoral appointees and aides have gone to jail in recent years. Compare that percentage to the few police officers and ask where is the real cover-up for corruption and scandal going on. Seems Daley and a whole lot of connected political mobsters should be in jail and have gotten away with it. The fetal position is a protective position that protects the soft body tissue from being damaged. Stay Fetal my brothers and sisters. Hopefully Futterman and Ford won't be able to continue making payments on their houses.

La Shawn Ford pleaded guilty to one misdemeanor tax charge in order to get 17 federal felony bank fraud charges dropped. Apparently, he's forgotten that fact. He also has accepted campaign contributions from SEIU, AFSCME, CTU, and the Illinois Federation of Teachers. No surprise there.

Question SCC .... I really don't give 2 sh!ts who the new superintendent is going to be, but since s/he will be appointed as the new chosen one--- will s/he also be wearing a body camera everywhere s/he goes? You know, like, meetings with Rham & the rest of the alder-cronies... Technically s/he will be an "honorary" Chicago police officer & per our "special" citizens of this wonderful city - they want ALL Chicago police officers to wear them at all times while on duty. {I know it'll never happen, but just for sh!ts & giggles)

It would also be interesting if Rham and the rest of his cronies carry a body camera all day long to check out what it is that they actually do & SAY (knowing that they are being recorded)... Them being public officials & all ... They can have their own show on any of their liberal channels of their choosing, or a make podcast, or a create webpage, or a YouTube channel ... It'll be called "Chicago 24/7"

How is this a big victory ? Based on political pressure Either the courts will reverse it or the state will enact laws to prevent it from happening. FOP should sue and each officer get a settlement. At least those whose old complaints ended up as public info

Go easy on State Representative Lashawn K. Ford. He has been having a difficult time. He was unable to submit a valid nominating petition for 29th Ward Democratic Committeeman and not even Madigan's election lawyer, Michael Kasper, could retrieve the situation for him. Ford was obliged to withdraw as a candidate in light of pattern of fraud allegations.

This is not a major victory for the FOP. This was long overdue. What good is a collective bargaining agreement with the city, if they go years without following it? We pay into our pension every pay check without fail. The city goes decades without paying into it and the public blaims us for grredy public sector pensions. We agree to a four year limit on discipline history because 99% of complaints are from career criminals with an ax to grind. The city ignores this provision too and the FOP has let it go for decades. The Supreme Court is about to rule on mandatory payments for public sector union members and it doesnt look good for the unions. Why would we pay in?

God Bless George Roumell, a very smart and fair man, although a blind man could have seen through this stack of bullshit.

I guess my late Uncle (deceased 1995) can finally Rest in Peace knowing they can't exhume him from his grave and make him answer for some ridiculous verbal beef from 1967! Or maybe the powers that be could give him a day retroactively and then deduct it from my Aunt's very meager pension check.

I don't see how they can possibly be covered by the contract. They are government records and need to be handled just like all other records kept by government bodies. If the record keeping law says they should be destroyed after some period of time than they should be destroyed.

Remember, only weeks ago the city was suspending officers who had read the Zak Emmanuel "robbery" report. Time to own up to a violation which spanned over 50 years ago. Just the type of violation which the IAD RAT SQUAD is famous for. So Deano - don't go pandering to Rahmulus that he'll be ok when it comes to damages - the majority of your membership will want to see the city to be sanctioned. Do the math and look at why teen violence is so high, u fix the court systems, u fix the violence on the streets of Chicago. Kids are stacking up charges like mega blocks, however, check the conviction rates and there proper rehabbing, its ridiculous. It's like pulling teeth! always has and will always be an enigma

they stand for.

Oh yeah...
During our (short) visitation to a "nicer" unit
of assignment, (Well, it was an adjustment
hearing the King's English as a native tongue)
we found that the allegedly more enlightened
"silent majority" are skittish about actual
unscripted, unfiltered dialog pertaining to how
safe they actually aren't in this city...

"You're scary and you're scaring US!
Please stop and go away."

Go through some of what I've seen already, entire watch gets gigged in massive complaint because one officer "did not address subj. using proper respect" or something. It is money, money, money, though, a fine living once you get adequate funding to grow pale and old under fluorescent lighting, digging through bales, whole skids of this ancient s__t.

Just keep your back turned firmly on all that shooting and motherf__ing and squealing car tires and breaking glass and pitbulls loudly trying to swallow their own chains going on behind you, and keep your gaze firmly fixed on The Police instead. The Usual Suspects are not subject to disclosure of their past indiscretions, but YOU are.
Mayor already gave up just about everything pertaining to every sworn member long ago, and like his and Hillarys emails, destroying a record doesn't mean it's gone forever.
Preventative measures for the future would be DONT DO ANYTHING MORE than writing your report and make your contact with the caller as brief, non-confrontational and professional as possible, if at all.

poor Lashawn ford, he has already swayed the new alderman of the 29th ward, Chris Zagliffia or similar name, anyways a CPD Sgt. to talk shit about police officers, I really hate it when a politician becomes the enemy of the ranks he once hailed from and begins to talk crap about how bad police are and that they pick on black folks. just ask anybody out on the streets who gives them a better shake and they will say they got better breaks from the white officers, black officers put their feet up the ass of black folks because they are an embarrassment to the black officers. I'm so happy that I'm gone from this job because anyonewho does anything other then the bare minimum is a fool, especially when you mayor is on TV saying that the police dept. is abusive towards the minority community, little weasel trying to save his own ASS!!!!!!

Rep. Ford seems to be attempting to write & introduce legislation on several subjects lately. Has anybody else noticed that
this individual most likely can't even spell his own name. Do you think that he is really the source of the new legislation. Might some other person be writing it for him. That is the real enemy to be watching. Ford hasn't the brains to come in out of the rain. Who is the real author and sponsor. Ford has to place his name on this as payment for a very questionable light sentence and being able to keep his spot in the legislature.

Just google Rep Ford. He should be in prison right now. He was indicted on 19 felony counts a year ago and was able to work-out a plea deal to plead guilty to 1 miss count and was mysteriously reelected...only in Chicago!

Do the math and look at why teen violence is so high, u fix the court systems, u fix the violence on the streets of Chicago. Kids are stacking up charges like mega blocks, however, check the conviction rates and there proper rehabbing, its ridiculous. It's like pulling teeth! You forgot to mention how Crook County changed the point system recently regarding holding Juveniles. This point system is different then what every other county in the state uses. Juvenile offenders who would have been detained a couple of months ago are sent home. This includes those who already are on electronic monitoring. If a member of my family was a victim of a crime committed by a juvenile who should have been detained under the old point system I would sue the $hit out of Cook County, Toni Prekwinkle and Tom Dart.

If these files are already in the grubby hands of those "journalists" and the ALCU it will be like the lawyers say trying to put toothpaste back in the tube.

The best we could hope for is that hey would be disallowed in any action and future files would be promptly destroyed.

But probably there would be moles in IAD or IPRA keeping their own personal set of files. Waiting for the right case or right opportunity to use them for the right price.

RAHM will drag his feet so the REV-runs- and carpetbagger lawyers get a chance at all that tasty info.
The City moves at light speed for taser and body-cams but contractual matter well not so much.
I am taking a wild guess her and the ass hate exempt at HQ in charge of file probably has not even put a plan in place to destroy the files.

Obviously you are one of the fools that believe what is heard around the water fountain. The city has not missed any payments into the fund. If you can read you can look it up on the Pension Board's website. That is not the problem with the pension. The problem is much more basic than that.

The Key Point being ignored in all of this is the simple word: CONTRACT. We are not talking here about some bullshit handshake as in the days of King Richard I. We are talking a Contractual Agreement, being that complaints that were Unfounded or Not Sustained would be removed from the record. To resurrect those records which in essence should not exist is a blatant breech of Contract and creates an atmosphere of ABSOLUTE DISTRUST. Who's managing the records room? Is it the cops? Get your Lodge brothers, and get those records gone before they pass some half-assed law. Leave the ones involved in lawsuits alone so you don't get a Judge pissed off at you - but take the rest, put it in a truck, and go to the south side with them and BURN THEM TO A CRISP. After it's done, do it again for good measure.

Once they're gone, they can pass whatever law they want, but it's essentially useless.

If your contract says something - then it's up to you as a party to the contract to ENFORCE THE CONTRACT.

Geezus, what the hell happened to the CPD I grew up with - grow a set and handle this.
