"Stop and Frisk" Fallout

  • The recent ruling to reform the New York Police Department's controversial 'stop-and-frisk' tactic has already led to a sharp rise in shootings, new figures reveal.
    In the month after the policy was ruled unconstitutional shootings spiked nearly 13 per cent while gun seizures fell almost a fifth, the figures show.

    In the 28 days up to September 8 there were 140 shootings across the city, compared with 124 over the same period last year, according to NYPD statistics.
Even Ray Charles saw this one coming - and he's been dead for almost a decade.

Off topic I know, but John Kass had an interesting column in Sunday's Tribune about Rahm, and how there are starting to be questions among the business and big money people about whether or not he has got what it takes to manage and run the city. It is nothing that we haven't known for some time but it is interesting reading. Like Kass or not, and I know that there are different opinions of him out there, he is one of the very few media creatures in this city and state who doesn't kiss the back sides of Obama, Daley and Emmanuel.

That is why I am taking a proactive approach. I signed up for the Sergeant's test. Now, all I have to do is get promoted to Sergeant and I will get Sergeant's pay. I am a doer, I take a proactive approach, and I have positive attitude. I already bought a Management book at Barnes and Noble. And, because I have a positive attitude, I already bought my Sergeant's uniform. You guys just have to learn to lift yourselves up by your bootstraps. All of this means that my contract is settled.

You'd be surprised how less stressful being the police is when all you really have to do to get thru the day is answer your calls for service and take enforcement action only when absolutely necessary.

Nothing proactive. Nothing that generates revenue for a city that religiously holds our contract hostage and violates our contract at the drop of a hat...

and nothing the administration can really do to fuck with you if you hold a bid spot.

Sure, there are a few things some supervisors might try to pull to inconvenience you, but the vast majority won't even entertain such thoughts because they know what time it is.

Ahhhh!! Life in patrol is good if you know how to pimp the job. The goofs still sticking their necks out, jumping through hoops for numbers to make the their "bosses" look good, for the occasional early duck or for that almighty take home car are truly rolling the dice.

As someone on "Sliders" once said, the Bill of Rights isn't a Chinese menu. You don't get to pick which parts you want to obey. It's a packaged deal.

Real easy to joke about when you aren't one of the "offended minorities" who got stopped for some non-articulable reason. I am. I have. And I'm a cop now...and I still haven't been able to rationally explain the bogus stop I was subjected to in my college dorm, getting frisked and run in my own lobby because I "fit the description." There were probably fifty people in the lobby when they got on scene and everyone left the lobby. We got stopped waiting on the elevator...all students...all lived in the dorms. PC is pc. Suspicious behavior is suspicious behavior. But when you stop someone, you better have a better reason than he has braids and his pants were sagging. I went to school with a guy who I NEVER see outside of a suit now. Sophomore year in high school, his lips were dark from all the blunts and he had a homemade thug life tattoo across his abdomen. Senior year he was voted most likely to succeed, got into DePaul, he got two college degrees and now he works downtown for a big firm. Some thugs "look like" choir boys and some "choir boys" look like thugs. If you can't articulate more than what you think someone looks like...that's on you and keep my name out of your paper.

It's too bad that some police officers do not realize how much real support they actually have .Down here we have no problem adding our firepower to the cops if they need us . Won't see that on CNN but we do it.

Stop and frisk is problematic for a lot of us though . What's the criteria for that? I'm a southern senior citizen. Would that meet probable cause? I think S and F is an effective tool, truly, but at what point does it cross into a Fourth Amendment issue? No one is his right mind expects a good cop to be a constitutional scholar, though I'll better they are better than the Community Organizer in Chief.

It's a thorny issue, it works ,profiling works, too but we can't admit that, so do we go in a shotgun approach? Totally random S & F on any street?

Not taking a shot at the PD, just getting things more clear in my age addled brain .

So what? It "violates the 4th Amendment" because one liberal lower court judge says so?

The practice is perfectly legal and constitutional. It was only ruled unconstitutional because this one judge found it had disparate impact on the usual minority groups, which is the weakest argument against a perfectly legitimate and constitutional practice since dedicated enforcement of Terry stops is bound to have a higher impact on ethnic groups in high crime areas. Just the same way the statement: "In Chicago more blacks murder each other than whites do," is not a racist smear but a fact that can be proven by statistics, not the Fibune editorial slant.

What do you mean it was never in effect here, SCC? How do you think those glorified tac teams (among others) got those one bagger arrests all these years? They did it by making random stops in the hood, and going through people until they found contraband. Then they tailored a narrative to suit their needs. Some of this still goes on every day.

If you are not a suspect the cops need to keep their dang paws off you, simple as that.

Now what do to about the murder rate?

Simple, no plea bargaining, no parole, no probation, no nothing. Flat jail, and without the TVs.

Add to that liberalized CCW carry for the good folks. YES CCW Chicago and NYC. Let the people defend themselves. Also add a Stand-Your-Ground and Castle doctrine set of laws.

Dodge City? Well even if that was a real possibility, which it ain't, I say a little blood on the street is needed till the Cretans learn to stop mugging people.

We should have a reboot.. 99 percent of our arrest reports are lies anyways as are the so called observations we make. The police are te biggest violators of civil rights out there... Too many hard asses out there. Feel free to reset

I'm no fan of violating the Constitution for any reason.

But you have to think a little - break it down.

Where does all this come from? SCOTUS said one violates the prohibition against unreasonable search/seizure when stopping with less that articulable reasonable suspicion that a crime is afoot.

Articulable reasonable suspicion. HMMM ... that's a pretty low standard. Honest mistakes are made for sure. But now a cop can be punished criminally ? Remember, the punishment used to be exclusion of the evidence obtained.

Whole different ballgame now.

In England if the cop screws up the evidence remains admissible, but the cop is liable civilly. Here, the evidence will be excluded, AND the cop will be liable criminally? Am I getting this right?

Who in their right mind would do a Terry stop in NYC?

Real easy to joke about when you aren't one of the "offended minorities" who got stopped for some non-articulable reason. I am. I have. And I'm a cop now...and I still haven't been able to rationally explain the bogus stop I was subjected to in my college dorm, getting frisked and run in my own lobby because I "fit the description." There were probably fifty people in the lobby when they got on scene and everyone left the lobby. We got stopped waiting on the elevator...all students...all lived in the dorms. PC is pc. Suspicious behavior is suspicious behavior. But when you stop someone, you better have a better reason than he has braids and his pants were sagging. I went to school with a guy who I NEVER see outside of a suit now. Sophomore year in high school, his lips were dark from all the blunts and he had a homemade thug life tattoo across his abdomen. Senior year he was voted most likely to succeed, got into DePaul, he got two college degrees and now he works downtown for a big firm. Some thugs "look like" choir boys and some "choir boys" look like thugs. If you can't articulate more than what you think someone looks like...that's on you and keep my name out of your paper.

I agree that ending the stop and frisk will cause numbers to go up. The stats speak for themselves. That said, if anyone thinks that stop and frisk s the same as a terry stop, they are wrong. SOME stop and frisk might be legit Terry stops, but it would be helpful for people to closely read the Terry v Ohio decision. The officer in Terry had a set of circumstances that went past just stopping a guy because of his or her looks.

And yes I am a 26 year copper.

----- Well said, but a little off the mark. Police officers only need reasonable suspicion to stop or to detain a person. Fitting the description is reasonable suspicion, and although I know you didn't like it, and obviously stopping you was not the right suspect, I hope you can eventually understand why it was done. With a little more time o n the job I'm sure you will. I know that cliché is often used, and it is never a suiting thing to hear... if you're the wrong person, but from the copper's standpoint, we don't always know who the right guy is without a little investigation and that includes stopping a few people. I'm a middle-aged white male, and I've fit the description too. White guy white offender, black guy black offender. If the offender was white, you wouldn't have been stopped, and vise versa. Maybe the officers could have explained the circumstances better after finding you were not the person they were looking for, but being a cop, you should, or soon will be able to realize that we sometimes have to throw a big net and toss the good back into society. As for the dude with the blunt, well it sounds like you know where to find him. And if his lips were burnt with weed, it sound like you might have yourself a proper felony arrest, with a guy that definitely matches the description.

New York had stop, listen, frisk. If the police had reasonable suspicion they could stop someone. The police did a good job articulating why they made their stop in this case, but the court found it to be a pretext. There is a lot of media misinformation about this case. There was no 4th amendment violation, left coast just couldn't be bothered to actually read the case.

Come on, now. We are all on the same team here. All Americans (except the illegal Mexicans of course). But it is inherent in our nation's fabric to treat all equally. From the Irish to the blacks to the Hispanics and so on. Granted that minorities commit more crime. I am certainly no PC type, but you can't stop someone based on a probability of their race. You still need that articulable suspicion.
On some level, we are all minorities, maybe not racially, but economically or whatever. Now, when you say more minorities get locked up that can be easily justified ... but you still need that threshold evidence (other than higher probability) to conduct the initial stop.

Bloomberg is as leftist as one can get. He tried (in a very un-American way) to sidestep the Constitution to get results. He did get results, but you cannot do it that way.

Nobody knows the difference but the police, so who cares? You think the public doesn't think we use 'perps'? They think police work is what they see on tv. I absolutely love the responses I get when I tell victims that prints take approximately two years to come back on burglaries....and that I'll call them when they do....bwhahahahaha!

And that is no b.s. I am regularly assigned cases from 2010, 2011, where the prints just hit--statute of limitations have already run on a bunch. Originally assigned to dics retired or promoted.

It's also not b.s. when I tell them that I have 50 cases ahead of theirs so I won't be going out tomorrow to arrest Shanekwa for bustin' out her windshield for datin' her old man for, oh, 3-4 months....maybe longer. Since there's no general assignment dics anymore, we've got all the nonsense to deal with in addition to the usual agg batts, robberies, etc.

It's pure bliss in the d-unit. Not that patrol is any better. We're all in the same sinking boat.

I don't have a chip on my shoulder. I never said it only happens to "minorities." The whole argument with Stop and Frisk has centered on "minorities" and nobody else, which is what I'm responding to. In actually, that one incident I mentioned was the light one. I did get hooked up and sent to county on a domestic with no victim/witness and a resisting that never happened.

I'm realistic with cops, preachers, you name it...just like I am with dude on the street. And when black people in general (especially in custody) start running off at the mouth on my white brothers alleging all kinds of foolishness..I CHECK THEM. Nobody has ever asked me to but I do it because it's right. Too many times my white partner was trying to give dude a break and I wanted to hook 'em up and when they get on that "white boy this and that" nonsense and I tell 'em you should shut your mouth because "white boy" is trying to give you a break. I do that because perception is a killer. Some of these people need to know that plenty of white cops are out there trying to help them and not sandbag them. On the other hand a lot of cops need to understand that if you've been sandbagged before (and genuinely didn't deserve it) it is very hard to undue that trust.

As far as saving the world..lol you must think I'm a set the poor felonious children free liberal. Wrong guy here. I lock them up, that is my contribution. As I informed this armed robber that wanted to call me brother, after he was hooked, the white cop driving the car is my brother..not you. I got brothers across the color spectrum dude, from high school to the military and into college, and beyond. I will defend them as brothers and I have.

You don't get it do you? There was no incident. I know the difference between RAS and PC. Let me clarify, they had no RAS. The whole lobby was filled with literally 50-100 people, 75% of them black. Everyone ran up the stairs and on the elevators to their rooms.

I had no problem when they arrived, I thought the desk called them because I was arguing with a female floormate over something stupid that happened on our floor.
I figured they were called because there were too many people in the lounge area to control. I was just going to tell them the truth, me and a friend were arguing, there is/was nothing physical happening. When they got there they said they were there for a battery with six offenders against one victim that just occurred at another dorm...across the street, where we hadn't seen anybody out all night. Our lobby had been packed all night, which was typical on latenight weekends with no parties.

By the way, imbecile has two Es.

Nope. I got stopped on the street before and though I was a little teenage prick at the end of the day, the coppers handled everything fine. I grew up and said to myself, man was I an asshole that day because they didn't do anything wrong.

I don't know where or when you went to school but we had cops that did walk and talks in the dorms buddy...haven't lived with mom and dad since I moved back during grad school and the only uniforms I wore that involved security have been military and police.

Ok, I read it. In the Floyd case the court said that the officers acted reasonably just as the officer in Terry acted reasonably. Read my post, I said that some stop and frisk incidents are legal, just as the Terry stop was legal. An officer making such a stop has to be able to articulate his reasons for the interaction. In Floyd, the court said that the officers, given the totality of the incident acted reasonably and that race was not a factor.

That said, using as reasonable suspicion the fact that a person is wearing droopy pants, or might have a blunt in his pocket is a 4th Amendment violation, no matter how bad we want to do it. It's all about being reasonable. Is it reasonable to believe that an officer is justified in patting someone down in a given situation? The courts said no.
