Gun Ban Fails Again

  • A federal judge in Chicago on Tuesday struck down a portion of the city’s firearm ordinance, calling it unconstitutional.

    U.S. District Judge Samuel Der-Yeghiayan ruled in favor of a Chicago man who challenged a section of the city’s gun law after he was denied a permit because of a misdemeanor conviction.

    Der-Yeghiayan, in a 30-page ruling, called that part of the Chicago Firearm Ordinance “unconstitutionally void for vagueness,” and said it violated Shawn Gowder’s right to keep and bear arms under the Second Amendment of the U.S. Constitution.

Rahm will continue to throw up roadblocks and he will continue to lose, wasting untold millions that Chicago can ill afford.

keep this in mind EVERYONE. what better if not free way to advocate tough gun laws? answer: Shootings, shootings, shootings! the city will introduce and pass another B.S. scheme and tie it up in the courts for several years. This city wants to eliminate your second amendment rights, you may not be a gun enthusiast but bless those who have them come to your aid when you need them the most. Im a P.O. and I can't even by ammo without a fucking foid card that says I can. not my star or police ID can get me ammo. These are rights! number two out of all of them! I thank that judge for calling out the city's B.S.!

Anyone who thinks Rahm will be less aggresive in their fight for total elimination of gun ownership by civilians is smoking dope! Rahm when he was a top advisor to B.J. Clinton is given almost exclusive credit for the Brady Bill.

"The Fourteenth Amendment to the Constitution forbids states from infringing the "privileges or immunities" of citizenship—a term that included not only the rights listed in the Bill of Rights but also common law rights and natural rights referred to in the Declaration of Independence. But Slaughter-House severely restricted the applicability of this clause, leaving Americans with little meaningful protection against state laws that interfere with their constitutional rights. Although in the years that followed, the Court imposed some significant limits on state authority, it has never overruled its earlier decision. Consequently, states still have broad power to pass laws that violate the rights of Americans—and particularly their economic freedom.

In its friend of the Court brief, PLF is urging the Supreme Court to overrule the Slaughter-House Cases and restore the privileges or immunities clause to its proper role as a meaningful guarantee against the abuses of state governments. Properly understood, that clause protects not only the right to possess firearms but other important rights, including private property rights and the right to earn a living and run a business without unreasonable government interference.

On June 28, 2010, the Supreme Court ruled that the right to bear arms is protected by the Due Process Clause, but refused to address the questions of the Privileges or Immunities Clause. In a separate opinon, however, Justice Clarence Thomas agreed with PLF's position that that clause should be respected and enforced as a critical protection for individual rights. Nevertheless, the decision is good news for individual freedom."

I would guess this would apply to city governments as well.

For practical reasons NY Does not have concealed carry. You need to be A. Wealthy, B. Powerful or C. connected to get a CC permit in NYC. That is NOT what we need here in Chicago. We need a shall issue system like Florida; where the residents of these terrorized neighborhoods who have been good law abiding citizens their whole lives can get a permit. Once a few bangers get gunned down trying to rob people I think the bangers might go back to doing something safer..like you know robbing other bangers.

Maybe the specific language of the law needs to be tweaked, but surely we can all agree that someone convicted of a gun crime should not be able to get another gun, right?

Because the City Council has a long history of knowingly and intentionally passing ordinances that violate the 2nd Amendment rights of the citizens to keep and bear arms, it would make sense that a Federal judge needs to step up to the plate and issue an injunction that NO new gun ordinances or changes shall be permitted in Chicago without a prior review by an independent legal panel to determine whether such an ordinance is Constitutional.

The City Council continues to knowingly violate the civil rights of the citizens, because their attitude is, "we are little dictators, we don't care about your rights, and if you don't like what we do, then take it to the U.S. Supreme Court," which they know could take years to hear the case, if anyone is willing to bear the legal costs of such a challenge,

Every alderman who voted "yes" on an un-Constitutional ordinance should be forced to resign. If there was any justice, they would also be indicted in Federal Court for civil rights violations, because they are doing this intentionally.

Have to agree he did pick up where Daley left off.. they want POWER and CONTROL.. and until the people of CHICAGO stand up they will keep trying to achieve it through these dumb bans.. People in CHICAGO without a FOID card.. without registering them either many guns were passed down throughout generations.. these are NOT gang bangers but honest everyday hard working people who choose to protect themselves first and ask forgiveness..

Greetings From Montana, the reason I left the "Shitty of Chicago" 15 years ago was that I couldn't walk out my door in RogersPark without a gun, that made me a criminal. Here I can carry all the guns I want. I NEVER DO, because there are no folks I want to shoot here,go figure. 99% of the people here have guns in their homes and cars, very little gun involved crime here in Montana. Maybe its the water?

I understand your position, but think about it a bit further. What if the original UUW arrest was for mere possession of a handgun within the city limits, or possession without a state FOID card? Since the city ordinance is unconstitutional and the state FOID Act probably is also, arrests based on either one shouldn't be considered.

New York state has a "may issue" concealed carry law that results in uneven availability of concealed carry licenses throughout the state depending on who the judge/police chief/etc. is. To make matters worse, licenses issued in other parts of the state are worthless in NYC and possibly in some other large cities. In NYC, as has already been explained, only the very rich, very important, or very connected can get unlimited concealed carry licenses. Ordinary citizens might be able to get a target/home permit, but forget a regular concealed carry.

Chicago needs a Hercules to flush out the Augean Stables that is its city hall and police headquarters. Good luck with that.

Montana has become the place where a lot of big city cops have retired. Flathead Valley and The Bitterroot valley which has very mild winters. The Bitterroot valley is known as the "Bannana Belt" of Montana. Much less snow and Cold then Shitago. Google it.
