Grievance Lost?

Can anyone confirm? We can't seem to find it on the FOP site:
  • The FOP has lost the first portion of the abritration grievance to the cancelation of the 5th period furloughs.

    The word is they are not going to fight it.

Anyone with the decision?

Are you surprised its not on their website. Unions usually dont inform their membership when they lose, only when they win. If true on this grieveance, they can say its not over there is a second half, so there was no reason to post this

This is pretty clear: Dept decides when furloughs are available. Interestingly, here is 29A.4, Union says in 2012 with Sunday as change day, you can extend in front and in back of your segment. The contract says: "OR". Think FOP could be wrong AGAIN?

Section 29A.3
Furlough shall be selected in accordance with this Agreement and procedure subject to operational needs, and approved individual furlough days may be taken by officers so requesting at the discretion of the Department.
Section 29A.4
Furlough may be extended at the request of an officer with the approval of the Department by the use of any accumulated compensatory time, baby furlough days, personal days and individual furlough days. A furlough extension is defined as the Sunday through Wednesday prior to the start of a furlough or the Thursday through Saturday at the completion of the furlough.

I brought a quick suggestion, let's strike, and someone said no you can't do that its in our contract. Well if the city can change whatever they want why can't we....

I agree with the strike argument; however, a union cannot be held responsible for this... they took it to the arbitor, who ruled. Be pissed at HIM, not the union.... I am not a fan of the union- think it has outlived its usefulness. I call it as I see it, and this is the arbitor's fault...

Said this earlier, they re-write the General Order beforehand and it's a done deal. Remember Jpud tried to circumvent the Contract and was DENIED because The Order stated otherwise, and an addendum followed. I can't recall the issue but I think it was to reallocate po's unit of assignment.
So it can be done. Contract language also uses the phrase "may", as in 'the Dept. may' deem a preplanned event as an emergency.
Looks like they found a way to screw us again.
Besides that, the City will and has broken many contracts, we will be disappointed.

I agree with the above poster. So what if the contract say you can't strike. The city routinely and as a matter of course, breaks the contract without care.

What are they going to do if we strike? Call the police and lock us up? Fire us and let all of the recruits in the academy take our place?

I have even heard from some of the sgts that they would be willing to consider a strike, too. So, if the blue shirts walkout and the frontline supervisors refuse to work then what?

Sounds like the making of a movie: A (Few) Day(s) Without the Police. I think such a movie would be a thriller.

Now Rahm is saying all of the tax hikes in the City are going to be used up by pensions. Well didn't the City not even pay into any City pension for the last 4 years? I still say it's political propaganda designed to screw the average city employee. Not to mention our pension fund is a completely different entity then the rest of the city.

The ones pushing it or who are willing to accept it are the ones who believe the Dept spin that it's the fast track to a cmnd spot. The Depts main pitch man is the cmdr at Mgmt Labor Affairs. He called a secret meeting with a group of Capt, most of which were the ones who put in applications to be cmdr. The Dept knows they have these guys in pocket since they are desperate to be cmdrs & know they can’t see beyond their quest for gold. The Capt reading this know who you are. At the secret meeting the desperate ones were told they are going to be fast-tracked, they are going to get Unit spots, they MIGHT get cars & why would they want to stay on the watch as Capt and have to do all that watch cmdr stuff like watch balancing, dealing with that nonsense when they can all have this alleged great spot. They were all told that they have to go back & really sell this in order to carry it off, so the few that still believe the lies of the MLA cmdr are the only ones pushing it. They are only the few & not the many. The Capt Union was told they won’t be getting cars, & only a couple will be going to units, but those who went to the secret meeting say no, they told us we will be so we must be true. Not only were they told they will get cars & blackberries, but they were never told that they are going to be losing ALL of their holidays, since they will all be considered non-essential personnel & will be mandated off. That is a $5000 pay cut off the top & they will also not be allowed OT. The secrete ones were never told that, the Dept. just blew smoke to get them to comply. I was told there’s been a CR generated against the MLA Cmdr & an unfair labor practice has been or is being filed based on the secret meeting & some threats that have come out because of the majority of the Capt refusing to go along with this. There are a few cmdrs who have bitten from the poison apple, & a few capt, only four of the ones who met in secret that also have or who are nibbling at it, but most say no Fu^&* way. It’s a feverish attempt by the Dept to set a series of things in motion to cut all the way down to PO through denial of promotion opportunities & to force out all of the Capt when they discover by accepting the XO program they were lied to and screwed & they all pull the plug. Those who don’t pull the plug can give up the XO spot but will have to go back to Lt because the rank of Capt will have intentionally been eliminated. And, since they accepted a merit spot, they will have been losing seniority in the rank of Lt so they will go back with reduced seniority. The Dept intends to eliminate a rank & expects or intends for the XO program to fail. They will stop filling those spots and while doing that think they have found a way to permanently stop paying Lts out of grade. Most of the Capt see this; there are only 4-5 who are talking it up. Their Union is planning to refuse it, but the City & the Dept are going to do it anyway, but they will lose it in court. Just like everything else we are going through right now, this is going to take a couple of years to straighten out. The court will overturn the Dept illegal activity & order changes, so once we get rid of McWhatever you want to call him & slowly unscrew everything he let City hall screw up we can start to right the ship as best as we can. Watch the Cmdr of MLA now, his spot is slipping away, he was supposed to get this done under the radar & without a challenge. NOT!

5th Period Grievance Update
The Lodge has received a few calls inquiring about the status of the class action grievance that was filed when the Department issued Department Notice D11-14. This Department Notice excluded furlough selections for a full 5th or split 5B furlough.

The status of this grievance is as follows: The Lodge has not been able to secure an arbitration date or come to an agreement as to which arbitrator will preside over the arbitration hearing. Any rumors to the contrary are completely false.

Recognized Vacancies

The Lodge has been notified by the Management and Labor Affairs Section that there will not be any recognized vacancies posted for the 13th Police Period.

You must have just gotten on. The Dept does what it wants. Again, do you think anyone has a choice when the department wants to change something? Do you realy think Captains want to be acting D/C without out of grade? Do you realy think Lts want to be "Station Supervisors" (the same as watch commanders) without out of grade? Do you really think any bid officer wants to be the "Station Supervisoer" just because they have the desk bid without out of grade? Nobody has a choice. Its your job descrirption the Dept is changing and thats that. Grievance will possibly get retro pay but going forward the Dept gets their way.

The, (the city) "planned" for it.

An emergency is an foreseen occurrence or situation.

A situation that occurs that is out of you control.

Tornadoes, floods, electrical power outages, earthquakes, the 9/11 murders are examples of emergencies.

You don't ask for and plan for a situation an call it an emergency.

We all know it's an emergency because we don't have the manpower to handle it and the G8 is coming regardless, period. The city is THE EMPLOYER!

YOU are the EMPLOYEE!

In every case, the city is likely to get what they want. If the city needs the employee to do something, then unless it is clearly outside the contract, the city will get what it wants.

If the employee wants something from the city, then it had better be in clear black and white in the contract and not based on the meaning of "an emergency". If the city wants something from the employee, it will almost always get unless the contract expressly forbids it in writing and intent.

If you think you can win by bending the meaning of the contract, then you are an idiot who will bankrupt your own union arbitrating hopeless causes.

Remember, every time you arbitrate anything, you are much more likely to lose than to win.

The idiot masses will arbitrate everything. The wise will choose their battles. But, since the idiots far outnumber the wise, it is clear this "union" is doomed.

The Lodge has received a few calls inquiring about the status of the class action grievance that was filed when the Department issued Department Notice D11-14. This Department Notice excluded furlough selections for a full 5th or split 5B furlough.

The Captains union is not going along with this at all! the city on the other hand is, regardless of what the Union thinks; the union will then file an unfair labor practice grievance and see where it will go from there, then the Lts. will also file. It is going to be messy. The only way the city may try to avoid a mess is to do the XO thing on a trial basis in some selected districts using Tac lts. as XO's (against their wishes of course) and then more grievances will follow. Hang on for a wild ride!

Well you did take an oath, and a strike would be a direct violation of that oath, if anybody cares about such things any more. On a practical level you should remember 2 things, first the air traffic controllers in 1981; second the fact that public employees are unpopular as it is, but a strike would make it worse. He even went on to say, we would be on the"commanders shit list"if they see a 5 anywhere on the furlough form. Really? Its come down to threats from a do nothing merit prick. Ove known coppers that have taken May furloughs for over 20 years, because of family, best prices for vacations, or not having enough time for summer furlough. Maurer tried constantly to improve and upgrade while he was at Aviation, he was stonewalled by that "woman," at every turn; she is actually the bully out there, she thinks because she was in Daley's pocket she could do whatever she pleased; Maurer was the only one who would stand up to her. I really don't recall a successful federal lawsuit against the police department when it came to operations. We sued to overturn the corrupt promotional exams in the 80's under Harold and lost. We sued to overturn the phony merit promotions under daley and lost. We even had the Better Govt. Association and news reporters on our side and we lost. For those who blog and are the first to say "sue" or "Grieve", you are just wasting your time and money.The FOP wins many grievances, but they seem to loose or compromise many major operational issues. The arbitrators want to split the difference at the very least or they will be striken by the city for future cases. Labor law is compromise. ANY company can restructure, eliminate positions or redefine positions and it will stand up.

I believe that all unions sleep with the employer, palin facts, when
i was a teamster truck driver many years back if a compoany wanted to get rid of an asshole driver or trouble maker, they swung with the business agent. I also believe that any head of any union should act for his people who made him. As a union leader you must be firm on issues when you approach the employee. you can't use threats of non compliance and work stops, but you can relate the probable outcome to the employer and then you have to make good onyour promises. I believe that some sort of accross the board work related good sensible job actions such as many zero tolerance arrests be made, tying up cars and leaving the district in a RAP. Write all those parking enforcement tickets . Be proactive, not refusing to do a job is not the answer. Piss the Sup and mayor off and let them punish yhou, then react again. You are doing the job that you get paid for, it's better on paper then not doing anything, and when the fine citizens complain, hey we the police are just doing our job. SEE YA!!!

0407 couldnt agree more. Arbitrators also tend to side with the city if any change is made, even against the contract , if it is for the safety of the city and citizens, to wit:G8
Take Operation Closed Market, was longer that the contractual 90 detail, wasnt done by seniority and all the dept did was change the word detail. City won that grievence
That should have been done by seniority which was spelled out in the contract
