FOP Sues Sun Times

  • The Fraternal Order of Police is suing both the city and the Sun-Times over the publishing of photo lineups that included the names and faces of police officers with former Mayor Richard Daley’s nephew and his friends.

    The Sun-Times published the photos in Monday’s newspaper with an article about how the lineups were conducted. The lineups included several police officers, then-Mayor Daley’s nephew, Richard J. Vanecko, and two of Vanecko’s friends.

    [...] The paper also published the names of the officers in the lineup, along with their height, weight, hair color, eye color and dates of birth.

    The lawsuit, filed Monday, alleges the Fraternal Order of Police (FOP) had reason to expect the city would not release the photos and the Sun-Times would not publish them. It also claims the city was in breach of contract because of a shared collective-bargaining agreement, and that the city should have prevented the Sun-Times from publishing the photos.

Once again, idiots in charge of the Department who never read or lived by a contract, making decisions in violation of that agreement and as a result, may end up costing the city hundreds of thousands of dollars.

Why would the city release line-up photos anyway? Are they subject to FOIA requests? I wouldn't think so. Investigative files and parts therein are usually only released to opposing attys per trial and procedure rules. Where did they get the photos???? Did the city really release them?

I feel sorry for the murdered victims family in this case, they never thought that after there son is laid out on the street from a vanecko punch, they would have to go through the "chicago way" of political stonewalling, disregard for the law, absolutely no help from the attorney general, states attorney, or any clouted, scared to do the right thing police detectives on up. And of course, the F.B.I. can't even save us from the stench, even though they know chicago is the most corrupt political city in the country. We feel your pain.

Yet ANOTHER reason not to participate in lineups! Detectives get d2 pay for a reason...let them earn it. Idid a lineup once (last time) and was left alone, unarmed and unsupervised in a room with 3 cobra gang bangers who started in with me cuz i wasnt one of them. After everything was all said and done, i asked the dicks what the fuck and they laughed and busted my balls about being a pussy! Fuck that...never again!

Not sure about the details, but I worked CTA last week, we were assigned to 018 and 1. I heard there was a guy in 018 who put himself in for honorable mentions for shoplifters on Michigan Ave caught and detained by store security. Any thought or facts to this?

The Fop is worthless. For crying out loud if anyone was at the last meeting or read the article in the November newsletter by Jim Mccarthy you would know. There is a full page article about 2 police supervisors a Lt and Sgt thqt took their team to eat at a fancy eyewitness house while on duty hoping for a discount. The Lt and Sgt along with their team didn't get their discount and had a huge bill. UN order to vent their frustration one supervisor opens a can of mace and sprays the plqce as he leaves. Now here we have our FOP defending these white shirt asshats whom each have a disciplinary history at our meeting as well as in a full page article in the November letter.


Can someone tell me who the hell is in charge over there making decisions? Is this really the case we want to defend and go after ipra with? We are all doomed. The clouted yet again slide by. Amazing what running McCormick place.security will get you out of. This is an embarrassment to anyone in uniform and down right disgusting for our Fop to even contemplate.

I like the feistiness of the FOP but I don't want them to get sidetracked and lose focus. We are under attack from Rahm and that's only going to intensify as contract time rolls around. Rahm would love to reduce us to moderately paid civil servants with sub par healthcare and sub par pension.

I'm not sure about the logic or legal basis for suing the Sun Times except making Mikey a hero to parts of his constituency, but the lawsuit against the city for violating the contract has merit.

By the way I love the word "merit".

I was thinking that someone with as little talent as me must be in line for some "merit" promotions very soon.

Freedom of Information Act. A lineup is not secret, attorney's can get all of it upon request. With black or hispanic offenders, there are always enough bodies in lockup. So they use prisoners normally. With 6 ft 2 white guys, usually not. So they use cops. Don't want your information out there, don't stand as filler in a lineup.

As a cop you should know that unless you were right there yourself, there are other versions of what happened.

McCarthy is in charge of the legal defense fund. Approval of large expenditures still have to go before the Board of Directors for a vote.

McCarthy is an attorney, also a JAG lawyer for the US Army, though he might be out of that now, unsure.

I'm not a fan of the union, I did not vote for Shields and I think he has shown weakness however, can we please stop bashing him when he actually acts on our behalf. He is damed if he does and damed if he doesn't.

I agree that you have to be careful in deciding what cases you take action on, (spending union money) but in this case I don't think it's such a terrible decision.

I don't love our leadership but you and I have a vested interest at stake and failure is not something we should wish upon him or our union.

McCarthy is a lawyer with no trial or court experience . He was elected to the FOP and lost for a reason. He is a great guy with a heart as big as both his feet combined but he is incompetent when it comes to down to any legal matter.

Anyone can get police investigative files, if the case is not active, by filing a freedom of information request. The reports will come heavily redacted. Tnen you have to go to court to have the redactions questioned. As long as the case is under investigation, the department can refuse to release the files.Of course, a subpeona by an attorney who is suing will also get the files with no redactions. it will be interesting if this suit goes anywhere. The press has a lot of leeway when it comes to public information and printing it. Don't forget, just about everyone has a camera out there and I am sure many police officers are on home movies. I really do not think anyone is going to get any money over this and I would be willing to bet the suit is dismissed.

As far as the Sun Times goes, I cant stand them but legally why can't they publish the photos if they were legally acquired thru the FOIA request. Seems to me a losing case and alot of FOP money down the drain

Actually I think shields has done just fine so far. He has spoken when he had to and remained quiet when he should. Contract talks have not started yet, so there should be no public comments on it yet. At this point he should only be speaking to the members, not the media. Time will tell.

He's been harping about getting contact cards to keep criminals busy and how arrests take officers off the street too long. They took a random sample and put their giant brains together and brainstormed why one POs activity suddenly dropped, was she on furlough, medical, light duty, no to all. they decided maybe she had some personal problems and started looking at how that was being addressed. Finally after playing twenty questions (is she a good worker, does she seem depressed...) with the watch secretary they figured it out, she was the acting time keeper while he was on furlough.

Idid a lineup once (last time) and was left alone, unarmed and unsupervised in a room with 3 cobra gang bangers who started in with me cuz i wasnt one of them. My guess is if Rahm authorized the release of the photos, he received legal opinions from the corporation counsel that legally he had a right to do so. He may not have had to do so, but was legally right to do so if he wanted. Adding his name to the suit adds noything. Allready the jusge refused an immediate injunction request from the FOP Hope FOP wins, but dont see this as a winner

First the detectives holding the lineup must locate persons who fit the description of the offender - have similar characteristics, height, weight, hair color, tattoos, etc. - in order for the lineup to be fair.

Second there is a good chance that the witnesses and/or victims who are going to view the lineup have already seen most of the detectives on the floor during the several times they were in the detective division being interviewed. That would not be a fair lineup.

Lineup fillers do not have to be police, but they are doing it more often because it is extremely difficult to find non criminal citizens who are willing to stand in a lineup.
