If It Looks Like a Duck....

...walks like a duck, sounds like a duck, it's probably a duck.

  • The decision by the Cook County state’s attorney’s office not to charge a nephew of Mayor Daley in the one-punch death of 21-year-old David Koschman in 2004 hung largely on the fact that witnesses couldn’t positively identify the nephew, Richard J. “R.J.” Vanecko, in a police lineup, according to prosecutors.

    State’s Attorney Anita Alvarez and the Chicago Police Department have refused to release photographs, though, of that lineup and of a second lineup in which witnesses identified two other men as being there with Vanecko when he threw the punch in a drunken confrontation on Division Street at Dearborn in the early morning hours of April 25, 2004.

    Now, the police are asking Illinois Attorney General Lisa Madigan’s office — where one of the two retired detectives who supervised those lineups now works — to ensure that those pictures, as well as some other records, aren’t made public.

The Department is asking Lisa Madigan (who unilaterally decided that FOID records are all part of the public record and that gun owners have no expectation of privacy) to seal investigative records - records that are pretty much obliged to be released to the defense in any criminal prosecution and are pretty much discoverable in any civil action.

We foresee many lawyers charging by the hour getting rich off of these court battles.

Though I am glad that the media keeps pushing this story - it stinks to high heaven - I still think that the news outlets do a shitty job of reporting the news anyway. They report half-truths, leave out facts, very minimally correct errors and they hide their agendas behind the 1st amendment.

I agree with them on this: the people have a right to know! And what I want to know is who checks out the media, their stories and their credentials. They disgust me as much as the Daley crime family.

Hopefully, the media will at least get this story right and stay on top of it as if it were reporting a story about a nitwit cop battering a tiny bar maid.

There is a sensational story there for the news. How there is so much crime being commited by the same criminals. The criminals know they would only spend a night in jail and get fed. There is no fear in the courts so they continue to do it over and over until they kill someone. Then people still want to rehabilitate the criminal.

They never used to even take photos of negative lineups. Why in the world would a negative lineup photo need to be published in a newspaper? For that matter, why would a positive lineup photo be suitable for a newspaper story? It's the same reason why the department does not release mug shots of people who have been arrested and released without charges.

Lineup photos and police reports are for court. They are not fodder for newspapers. They are not given away to the public to feed their curiosity.

Anita Alverez is the chief law enforcement official in Cook County. She can initiate grand jury investigations, just as easy as federal prosecutors can. In fact, years ago Devine initiated a GJ investigation when a clouted water department official was choked out at a suburban wedding and witnesses refused to cooperate with the police investigation.

Anita doesn't need the Chicago Police to open a case so she can prosecute. She doesnt need the State Police to investigate, so she can prosecute. Anita is in charge, not the police department.

The proper question is why isn't she starting a GJ instigation? The Scum Times doesn't ask that because they would get no info from a GJ investigation. All they want is to sell papers and lineup photos would do just that.

In any event, the ASA prepares a Felony Review file which is on record to assist in the present investigation or when the investigation might be reopened due to investigative leads. This Felony Review file prepared by the ASA tells the real facts of the past investigation.

The mistake made here was not presenting the case and having charges rejected. The offender obviously is identified or it never have been ccxed. To highlight, det. yawger went public on his own merit and validit, because he is officially retired and working for another department , which is technically nobody's business. The point is Yawger talked to the press about his experience.

If anyone saw that article last week, Yawger said that they all would have loved to put a "daley" clan member in jail if they could legally do so.

Although Yawger spoke freely, and more freely than anoyone else would have, there were loop holes that made one wonder what type of detective allowed that to happen. Especially one with such an open "honest" opinion.

Obiously they want Yawger and then some, to keep their mouths shut to the press.

work in that area so been to that court. just about every one or two bag dope case in that court has been dismissed with no PC even before that judge for years. no news there. I adapted and dont arrest someone for a one bagger. life isn't that difficult. the weed dismissal part I can't comment on cause I havent seen that.

Go ahead and make shit up asshat. The police do the investigation, interview witnesses, take statments and run the lineups. Who gives a flying fuck what is put into the Felony Review file? Have you ever even seen what the file looks like? There is not one single thing in there that is not in the PD reports except one of four notations-Approved, Rejected, C/I (continuing investigation) or Advice. Everything else is BS and you are full of it.

I do not recall photos ever taken of a negative lineup. I am retired, tho, have things changed? Anyway, cops are in this line-up, I do not think any photos should be released. They are not to be printed in any newspaper. States' attorney notes from felony review are really pretty brief, and usually damn hard to read. I have to give weight to the investigating detectives in this matter. I just do not believe that any CPD detective would cover up a case and sell his soul. They present their case to felony review and the on scene ASA makes the call. End of story. Blame the states attorney in this matter, not the police. But, after all, the police are an easy target for every scum reporter and politician who needs something/someone to focus on and make a few headlines.

If you don't believe that they have already looked at this whole thing to see if there is a Federal crime committed, you might want to buy a bridge. Not everything is covered by federal statutes, in point of fact, very little is. They usually hang their hats on Civil Rights charges, but that requires a state or local official depriving someone of their rights, trying to use the cover of a law or ordinance. OT: California’s Supreme Court has ruled in, People v Gregory Diaz, that police do not need a search warrant to read text messages on a suspect’s cell phone. A search warrant is a court order issued by a judge that authorizes police officers to search a person or place for evidence of a crime. In 2007, Gregory Diaz was arrested for selling drugs. The police found drugs in his possession, but also looked on his cell phone and found a text message about buying and selling drugs. Mr. Diaz however argued that this was an unlawful search and seizure. The decision was 5-2 in favor of warrantless searches of cell phones. The kid didn't get charged with a crime because he didn't commit a crime. Regardless of who he is! all the witnesses at the time said the other kid was the aggressor. REGARDLESS of his size....you are not required get punched in the mouth because you are big!

(OT) Looks like michelles cousin mike shields is the owner of a "rental section 8 property"that CPD has been called to over 21 times on 97th and Hoyne. Watched fox news at 9 investigation and mike was on he had "no idea" the police were there so many times. dane placko interviewed neighbors and they said they were scared with their kids riding bikes near that crime house. great he wants to be cpd boss and has no clue about what is going on at his own property! The mistake made here was not presenting the case and having charges rejected. The offender obviously is identified or it never have been ccxed. THE ASA O'Brien refused charges not the police. The press jags make it sound like the lineup was fixed. They normally use people from the district or area lockups as line-up fill-ins.
The reason they probably had to resort to using P.O.'s as the extras was the fact that there were no 'white people' in the lock-ups to use.

There is no statute of limitations for any murder related charges including manslaughter. Carol Marin showed her ignorance when she repeatedly reported that.

Now a civil wrongful death suit, that statute of limitations pasted a year after the incident. The plaintiff (victim's mother) may be able to claim that the identity of the defendant (Vanecko) was concealed from her and the fact that the CPD just closed the case this year may help her case. But, the clock is ticking now that the word is out and if she is going to file suit, she had better do so immediately.

Drug arrests are not a waste of time.
1. it gets shithead dealer off the street for a while
2. it prevents shithead user from breaking into stuff to feed his habit for a while
3. it gives those who are directly affected by shithead user or dealer a break from their bullshit for a while
4. it prevents shithead dealer from engaging in gunplay for a while, because believe it or not every once in a while someone decent gets victimized by said gunplay
5. it prevents shithead user from driving high or doing some other activity that could affect yours or those you love safety
6. it prevents shithead user and dealer from getting pregnant for a while and fucking up some future person's life
7. very imporantly it prevents shithead dealer's criminal organization from amassing more and more money, which could eventually be used to delve into politics and REALLY REALLY fuck up this country even more so than it already is

Anyone actually there when this happened? Didn't think so. Maybe the reason nothing is happening in the case is because nothing criminal happened that night. It wouldn't be the first time that I know of where people wanted to lynch an innocent man....I know the conspiracy theory is the most interesting possibility in this case, but lets be honest drunken fight outside a club smaller guy(napoleon complex) starts a fight with someone else gets ass kicked.
