Opportunistic Lawsuit

  • On a summer evening six years ago, Jose Fematt and his younger sister did what most kids do as the day fades — they changed into their pajamas and planted themselves on the front-room couch to watch television.

    Outside the three large windows of the first-floor apartment, Jose, 13, who was baby-sitting his sister, heard a commotion and saw the glow of flashlights in the dark. Suddenly, the family's apartment door crashed open, and plainclothes Chicago police officers barged in with their guns drawn and yelling at the stunned children, according to a recently filed lawsuit.

    The officers were part of the Special Operations Section, or SOS, an elite squad that investigated drugs and guns. They were also rogue cops who were later convicted of terrorizing numerous residents with home invasions, illegal searches and trumped-up charges in one of the department's most infamous scandals. The unit was disbanded in 2007.
So the incident occurred in 2005, the unit was disbanded in 2007, anyone doing jail time finished serving their sentences two and three years ago aside from the "ringleaders." The rest of the case is stagnating six years after the fact and this lawsuit just gets filed now?

This is telling:
  • The family didn't report the break-in at the time because they were so frightened, according to their lawyer, Torreya Hamilton, who declined for Fematt, now 19, to be interviewed because she hasn't even let city attorneys question him yet.

    Fematt's account came to light only after Chagolla filed his own federal lawsuit. In January the city contacted Fematt after he was identified as a potential witness in court filings. Concerned about what the city wanted, the family contacted an attorney. What they learned was that Fematt could still file a lawsuit because he was a minor at the time of the break-in. The two-year time limit to file a civil suit had begun just a year earlier when Fematt turned 18.
We aren't excusing dirty cops doing home invasions on dope stash houses, but this has all the hallmarks of a gold digging lawsuit.

Its a stretch at this point using the term dirty cops. Not one person has done more than a six month sentence. And those were all pleas. This case was a joke from the beginning. This was supposed to be the biggest corruption case in police history. Yet only one person is still in jail.

In light of the recent spate of outlandish acts of violence against The Police, it would seem that the City Hall & local media propaganda campaign against the "out of control" Police had started to lose traction so they had every incentive to play this forward in a big way to generate some anti-police sentiment.

Nice way to deflect from the wilding and tree branch buggering that is rendering the streets of 001and 018 unfit for decent people.

We smile a bit because people are already starting to wonder why so much energy is expended by the city and the media in damning The Police instead of the roving bands of wilding assholes.

If they can't eat it, fuck it, or steal it, they break it or otherwise render it unuseable but it's The Police who are so "out of control?"

Chicago has gone mad.

The incident occurred in 2004 while Ms. Hamilton was the Senior Counsel. Just another POS defense attorney. Move along, nothing to see here.

moral of the story. do what you have to do to make an arrest but dont be an idiot and criminal about it. these guys were way out of line with what they did. some of the guys made arrests and did what they had to do to make the arrests and "articulate" the facts. These guys from the sounds of it were just straight up crooks. They deserve what they got. They became criminals. if your gonna arrest the guy then arrest him. if you got into the house by an "unconventional means" and were able to make the arrest then do it legit. Articulate your PC to get in the house and recover the gun, recover the dope and recover all of the money!!! Dont think your doing a good job because you got the dope and bad guy and your entitled to take money. thats BS!!! We are cops not criminals! Dont steal money, dont beat people and dont screw off when your off duty. Sometimes to catch the bad guy youve got to venture into that gray area..just dont cross the line and feel that you deserve some extra cash. Im proud to say that everyone ive ever worked with ive never seen one person ever take a dime from anyone... the public thinks we probably all take bribes and steal etc. 99.9 percent of this department is honorable... the rest are finnegan and company who think they are untouchable and can take what they want. they have no buisness wearing our uniform

Here's some advice to folks who are bitching. A lot of new police don't want to put the time in or dig. Here's the point on a beat car you can do it all: dope, stolen cars, fugatives, rapist, murder, arson, DUI, pistols, kidnapers, arrested high ranking gang leaders, solved robbery & burglary patterns, placed armed robbers in cuffs, done search warrants, put criminals in prison. All from a beat car. I understand getting away from the radio, but some of finest work as an officer has stemed from going to a oemc job. All those units must be fun, and look neat on paper, but my partners an I have done it all in a blue shirt, all I ask is this" I've called for help, and chances are I will again, provide me back-up" that's it, that's all I will ask.

Citizen Weis was in charge then, besides fucking him on a deposition, and asking him a bunch of uncomfortable questions, I could think of at least 500, 40 of which would have his team of attorneys shitting,,,every lawsuit in the past three years involving the Chicago Police Department should depose that pumpkin headed idiot...first let's make sure his contract says the city picks his attorneys...if not let's make sure he pays for it,,,betcha,,,

What, are you insane? This may be an opportunistic lawsuit, but that does not take away the fact the DIRTY police officers conducted a home invasion. For defamation, you have to prove that you alleged something you KNEW what false. Where is this statement false? Are we still supporting Finnegan, Herrera, Hopkins, etc? Come on guys - they were dirty and we all know it. Save your support for those who simply made a mistake, but did not commit a crime.

Off-Duty Officer Involved In Far South Side Shooting

An off-duty Chicago police officer was involved in a shooting this morning in the Far South Side's Fernwood neighborhood, police said.

Chicago police confirmed that shots were fired and that the officer was not injured. It was not immediately clear if anyone else was hurt, a spokesman said.

The incident happened at about 7:50 a.m. in the 10000 block of South Princeton Avenue.

Torreya Hamilton was first an assistant states attorney then a corporation counsel. She leanred the system and then exploited it. She also teaches lawyers how to sue the city and more specifically the police.

It might just be an " opprtunistic lawsuit", but it is hardly defensible. These officers just did everything posible to open the door and lay the groundwork for such claims. What grounds did they use to gain entry and search the entire house and turn things over? Does not look like they had anything: not a buy bust, no warrent, no plain view? Cops in NY have gone to prision for burglary convictions for just such home invasions. This clearly is not someone "doing their job". It just looks like nothing else could be proven at the time. They did everything wrong.

UPDATE: Cops: Off-duty officer fatally shoots house intruder...

An off-duty Chicago police officer shot and killed an armed intruder in his home in the Fernwood neighborhood on the Far South Side, police said.

The intruder made his way into the officer's home and attacked the officer with a "cutting instrument," according to Chicago Police Officer John Mirabelli, citing preliminary information.

Fearing for his life, the officer fired his gun at the intruder, hitting him, police said.




Score another one for the good guys.

An off-duty Chicago Police officer fatally shot a man who tried to break into the officer’s Far South Side Roseland neighborhood home Tuesday morning.

Just before 8 a.m. Tuesday, an intruder armed with a weapon entered the home of an off-duty officer in the 10000 block of South Princeton Avenue, according to police News Affairs Officer John Mirabelli.

“The intruder attempted to attack the officer who, in fear for his left, shot the suspect,” Mirabelli said.

The suspect, who was armed with some type of cutting instrument, according to preliminary information, was “very critically” injured, Mirabelli said.

The Cook County Medical Examiner’s office confirmed the fatality, but had no further information as of 9:40 a.m.

The officer was not injured, Mirabelli said. Calumet Area detectives and the Independent Police Review Authority are investigating.

That Torreya Hamilton has clearly joined the "dark side." She used to be an ASA at 26th Cal. then went to corporation counsel. then she goes private representing the criminals who sue the city. All those years when she was learning the "trade," she took what she learned to later use it against the city and against the police. she also thinks of herself as an "up and coming" country singer. that girl is just plain wrong.

makes you wonder if the prosecutor or corporation counsel you work with today, will turn around and sue you tomorrow.

The people who pled guilty did so to things like "Attempted Official Misconduct"(never had heard of that one before), and "Official Misconduct". Those are very broad charges that can encompass a false report, which could be a case report with an inaccurate time, an overtime slip with a mistake etc. etc. The most serious criminal charges placed against people from SOS were dropped a couple years ago at 26th Street. The cases were trumped up bullshit and fell apart under the legal microscope of criminal court. A dope dealer had his drugs and money taken by the CPD so he then claims years later, after his case is dismissed, that he actually had a lot more money than was inventoried. The drugs though were not his. Wow, some scandal.

anyone else notice that on chicagobreakingnews.com that when there is a story about the police the comments section is always enabled but when there is a story about a criminal and the terrible crimes they had committed all comments are disabled? This is the case almost everytime. This story about the sos thing has commenting allowed. The story about the officer shooting and killing the burglar to his house has comments enabled. The story about the cop who saved the man from the burning car had comments disabled. The story about the parolee charged with agg batt and csa downtown has comments disabled. The story about the feds who are getting sued for wrongful arrest has comments enabled but the story of the teen that got kilt for retaliation of a murder he had committed over the summer but was released without charges has comments disabled. coincidence?? I think not. The media loves to get people talking and bashing the police on stories that involve police. if it involves the poor criminal who was just confused then they dont want any comments that might be negative.

Every lawsuit, by definition, is opportunistic.

If these were rogue cops busting down doors illegaly, and shaking people down, then this kid has a case and he should pursue it.

Not every lawsuit against the CPD or any other department is without merit. There certainly are a lot of frivolous lawsuts taken against police departments, but this doesn't appear to be one of them.

He's still within the time frame to file, and he has a case. Why wouldn't he sue?

Kind of hard to sing their praises when 90% of them admitted guilt and pointed out others. They picked what they thought were perfect victims. Illegals involved in the dope game...they weren't the first, they won't be the last.

Is JF the "most corrupt cop ever"? Not by a mile, but let's remember he still hasn't been charged with a crime! The Guantanamo prisoners have been treated more fairly... JF has spent the last 4 years or more in solitary at the MCC. Even if he is guilty, he's paid his debt in my opinion.

Act like a professional. Period. Don't MF citizens, don't steal ANYTHING, and don't put hands on someone because they piss you off. Those three rules will insure a happy retirement. Only a fool would do differently. If you can't outsmart them, you have no business whining about your 30 days!

TO WHOEVER WROTE THIS, The Chicago Police Promotional Testing process is so corrupt there is no fixing it, without blowing it to pieces. I have been around long enough to know "NOTIFY THE WATCH COMMANDER" was the right answer, just as "NOTIFY THE COOK COUNTY FOREST PRESERVE POLICE" was the right answer to the last Sgts. test. To GEORGES and KENNEDY we all know MAUER gave you the answers to the lieutenants test. WE all know KOBEL held a private class for the detectives test where he gave out the answers and was forced to resign. We all know the tact team in 11 where everyone made detective on the last list and some people even made Sgt. I tried to initiate a CR number to Sgt. BOEHLMER in IAD about the KOBEL class and was totally ignored. WHY?

If you bothered to read the article it mentions Fermatt was a juvenile @ the time of incident. There arent statues of limitations when it come to juveniles. The Ryan Harris Kids comes to mind.

Listen Up, I was a Sergeant in SOS when this crap hit, The comment on no White Shirts being indicted is crap, a few Sgts. got stripped, one resigned because of Lt. Jake Blake micro managing the Sgts. on his watch. This certain Sgt from time to time had the team of misfits and objected to them going where they wanted but he was always overruled by Blake. He was notr indicted but where there is smoke there is fire, I'm sure that they were not angels but neither were the alledged victims. Blake made his guys go out there and getr guns, any way they could was good, just so he was made to look good and his watch just had to be better then the Baron's watch, and where did it get him, he retired real fast, as soon as he chit 50, ran out on this whole big investigation. It was a good unit and not everyone was bad.

Here's some advice to folks who are bitching. A lot of new police don't want to put the time in or dig. Here's the point on a beat car you can do it all: dope, stolen cars, fugatives, rapist, murder, arson, DUI, pistols, kidnapers, arrested high ranking gang leaders, solved robbery & burglary patterns, placed armed robbers in cuffs, done search warrants, put criminals in prison. All from a beat car. I understand getting away from the radio, but some of finest work as an officer has stemed from going to a oemc job. All those units must be fun, and look neat on paper, but my partners an I have done it all in a blue shirt, all I ask is this" I've called for help, and chances are I will again, provide me back-up" that's it, that's all I will ask.

To the sgt beefing about Jake you can tell by your comments that you worked the other watch. You know the one that really didn't do much. So since you didn't work for the man stfu. So quit trying to criticize his watches hard work with your nonsense. Apparently the prosecutors disagree with your analogy about the watch being dirty since there is only one person still in jail. And he's awaiting trial. So keep talking about your watches drinkers and one bag arrests and leave the real police work to others better suited for it. Maybe if you did more work you'd have less time to whine.
