FOID Privacy Advances

  • A measure that would keep the state’s list of registered gun owners private has advanced in the Illinois House.

    The House Judiciary Committee voted 9-1 on Wednesday to exempt the list of Firearm Owner’s Identification (FOID) card holders from the state’s Freedom of Information Act.

    Earlier this month, Illinois Attorney General Lisa Madigan ruled that the Illinois State Police must release the names of the state’s registered FOID card holders because it is public information not exempted from FOIA access laws.

Here's a better idea - get rid of the FOID card. Illinois stands alone among the 50 states as requiring this inane piece of documentation. We don't know what politicians think is so unique among our citizenry that having this little piece of plastic somehow impacts gun violence but we can say that among the many gun arrests we've seen, made, participated in, etc., the number of people with valid FOID cards is well under ten, probably under five. It's an unnecessary government intrusion on a basic Constitutional Right.

And we're trying to figure out this comment by a supposed republican that doesn't seem to help our cause:
  • Citing nervous gun owners who are “up in arms, literally,” State Rep. Richard Morthland (R-Moline) sponsored legislation that would exempt the state’s FOID card list from FOIA requests.
We don't see anyone "up in arms" over this issue. We aren't wild-eyed gun nuts looking to overthrow the established order by force of arms. Statements like that, whether intentional or not, don't do us much good if it can be twisted into something other than what was intended.

We know that the regular left-tard anti-gun trolls will be checking in here again. Try not to waste your time - we won't be publishing your comments. We advocate concealed carry and responsible gun ownership for all Americans as the Founding Fathers intended. If you don't want to own a gun, don't. But don't expect us to kowtow to your willingness to surrender a Constitutionally guaranteed right. And before you start screaming "censorship!" we remind you that censorship is a government function. We aren't the government. No one is stopping you from starting your own blog and advocating your position to the best of your ability. We're just stopping you from polluting this bandwidth.

SCC, Thanks for standing up to the anti-gun trolls. When the strong arm robbery crews terrorized the Northside a couple of years back, my gun pretty much covered all of the bases as far as getting to the house from the parking lot. Thats real security !

This is a privately owned blog and you don't have the guarantee of the first amendment here.

Did you ever notice that liberals are all about choise and freedom as long as it is only from their point of view? Dissenting views are simply not tolerated. If you have the temerity to disagree with them, out come the screams of homophobe, xenophobe, racist, nativist and bigot.

They still hate the troops, the difference now is they pretend to like the soldiers but hate the mission. They learned their lesson spitting on soldiers returning from Viet Nam, it made people realize what scum liberals really are. The FOID needs to go. Just another step to block the people from their Second Amendment Right to keep and bear arms.

The new Daley anti-gun ordinance after getting spanked by the Supreme Court is just as bad and will be challenged for its anti-constitution language as well.

This should be a no-brainer. Publishing a list of houses to burglarize? Wonderful.

This is why I have a box at the nearby UPS Store. I have my FIOD registered there and have for years. For a couple of hundred a year I use that UPS Store address for many things.

I just looked at HB3500 and there are already enough co-sponsors signed up to pass the bill in the House. Here's what >REALLY< surprised me; two of the co-sponsors and Deborah Mell and John D'Amico - both north side anti-gun liberals.
It kinda sounds like Lisa {AKA Mikie's daughter} stepped in it big time.

I advocate registering all persons who want to exercise their First Amendment rights as reporters. List their home addresses (and maybe their home phone numbers). That's when you would see whining and gnashing of teeth.

FOID deprives gun owners of their second amendment right to possess a firearm, as well as their the fourth, fifth and fourteenth amendment right to due process.

FOID is, on its face, unconstitutional.

I recall when I was a young copper police were not required to have an FOID.

In 1968 a new gun control act was passed in response to race riots in some of our major cities. From this Act a whole new generation of gun control laws were created in the states. In 1992 Jews for Preservation of Firearm Ownership Inc, published Gun Control: Gateway to Tyranny, which contains the actual text of pre Nazi, and Nazi gun control laws. Since white liberal racism energized the '68 Act, seeing it as a tool to further their socialist agenda, Mayor Daley Sr. of Chicago used his influence to bring about a Firearm Owners Identification (FOID) card in Illinois as a response to race riot concerns in Chicago. The FOID card was believed to be a powerful tool, to keep guns out of the hands of certain groups in the state deemed dangerous to Daley.

I've got a better idea, just get rid of the FOID card altogether. We are the only state that requires a seperate ID to own a gun. You can't publish what doesn't exist.

Let's put the shoe on the OTHER foot.

ALL non-gun owners should pay a fee of $250 a year because they are a burden to public safety by disregarding the Constitution by NOT having a means to defend themselves, thereby creating an extra dependency on local and county resources for protection.

ALL gun owners would be exempt from this fee but all NON-gun owners would have to register with the state.

Having to call 911 for any robbery and/or burglary and finding out this household was unarmed would generate another $500 fine due to sending out police resources.

Agreed the FOID is completely useless. What is the purpose since a background check is already needed to purchase a handgun? It's also ridiculous to have to show a FOID just to handle a firearm at a dealer.
Get rid of it.

you, Sir, are still allowed to obtain, posess, and handle a firearm. However, I strongly advise you visit a library, obtain your G.E.D. and then attempt "english while on a computer".

I would also advise a visit to a competentant Dr. for a visectomy. Preferrably before you go "earn" that G.E.D.

The case of Heller v. Washington DC was a well written case. Justice Scalia broke down the 2nd Amendment and interpreted the wording of the Amendment as to how they were defined at the time. Scalia stated that having a gun was clearly a fundamental right equivalent to that of free speech and religion. I am with you with the concealed carry law big time. It would be nice to see some old man pop one of these dogs on Chicago Ave. Scalia stated that the right extended to protection of the home not outside. However each state had the right to decide that question for their own citizens. Hope concealed carry passes.

At this point in time with the city of Chicago and the State of Illinois both going broke and looking to make budget cuts the FOID process should be given serious consideration of being cut.

We should look at the cost benefit of the program and the accountability of it -- meaning -- is it serving the purposed that it was designed to do.

Recently, on Mar 5, 2011 a story published on pjstar.com reported

Based on the latest U.S. Census population figures and recent Illinois State Police statistics on the numbers of Firearms Owner Identification Card holders, Dunlap has 309 more FOID card holders than it has adult residents.

Asked to double check for discrepancies in city-by-city figures of FOID card holders, ISP spokesman Scott Compton said, via e-mail, the agency could not provide clarification.

"Unfortunately, the system being used to pull this data is very antiquated and was not originally intended or developed for such queries."

You have to be kidding me right?

First off the accuracy of the database is in question and then you are going to sit there and tell us that the computer system is antiquated and that you can't pull a list or count of names out by zip code or city?!

You can take a high school kid out of a technology class and have him put together a Microsoft Excel spreadsheet or Access database in a matter of days to produce that info.

Because of these problems one can only wonder if this entire FOID process is nothing more than another revenue generation scheme that really doesn't pay for itself.

Seriously people, what good is having all the information in a computer if you are unable to access it in meaningful ways and/or it's fill with discrepancies?

The population of Illinois is said to be about 13 million. We have a workforce of around 6 million and the number of FOID card holders in Illinois is 1.6 million. That's a sizable lobby group my friends and it's time to stand up and be counted.

You can see the alternative right?

Higher fee's to upgrade the FOID system and its staff. Enough with the taxes and licenses nonsense enough!

Look at the busiest year on record 2009. About 16,000 FOID cards either denied or revoked out of 320,000. About 5%. However we should question those numbers further. How many were later approved upon appeal or wrongly suspended or revoked. Most likely we won't get those answers because the system wasn't designed to provide them. ha.

More importantly how many of the five percent would be caught anyway with a five day waiting period and background check at time of purchase. And finally how serious can we be about the entire FOID card process with the way our court system handles the offenders?

Maggers your wrong. Go to the heller decision and start on page 10. Scalia clearly talked about the right to keep and carry in case of confrontation. And cited state v reid from alabama as for carrying a firearm.

Further moremthe holding in heller was for lawful purposes SUCH AS self defense in the home. Heller also described lawful activities as hunting, unless its a two legged perp, i dont do much hunting inside my home.

FOID is a slap in the face to the United States Constitution. Then again, so is the entire state of Illinois.

The bullshit FOID card system is nothing more than a waste of tax dollars supporting a system that must employ state workers and state police who could be of better use working on legitimate law enforcement issues.

Add the cost of the workers, their salary and benefits, their offices and equipment and the thousands of wasted man hours and tell me that there is some legitimate use for this redundant and oppressive system. You can't.

Hey Quinn, You want to start cutting unnecessary spending? Start with the entire FOID system. If a background is already required, why are we even bothering with this? Idiot.

I believe the FOID card serves no useful purpose. It does not reduce violent crime. It creates non- violent criminals out of peaceable citizens who don't renew their people registration but possess a firearm or ammunition. I have never known a gangbanger or murderer or armed robber to have an FOID card. The FOID card act should be abolished, crushed, stomped on, and voided. But no lawmaker has the wisdom and guts to promote the abolition of this wasteful law.

I will No Longer lock anyone up who does not have a FOI Card, if they are not wanted, have a clear name check, and are not breaking any Laws. Requiring the FOID is Unconstitutional.

ALL of Daleys Chicago Firearms ordinances are UnConstitutional, as they are in direct opposition with the 2nd Amendment of the U.S. Constitution, therefore null , void, and Illegal.

According to the Elmhurst Press, “Illinois Attorney General Lisa Madigan bills herself the champion of open government and Freedom of Information Act reform.” That’s a bold statement in such a corrupt and opaque state, but a tremendous bump-sticker for political marketing.

So, where’s Lisa? This week, the Illinois Senate is debating SB1645 which would severely curtail the citizen’s “Right to Know” under the Freedom of Information Act (FOIA). In 2008, Lisa Madigan personally spearheaded the rewrite of the Illinois FOIA law. It’s her baby. But, SB1645 would gut it. Gutting citizen access to public information, SB1645 would strictly limit and regulate citizen questions of our government.

Where is Lisa Madigan?

Two years ago, in the days after Rod Blagojevich, the Chicago Tribune editorialized that Illinois should adopt the Florida standard of sunshine transparency- every public document online. Government wasn’t complying with information requests on a timely basis. In the internet age, citizens shouldn’t bear the burden of requesting. Government should be proactive.

Lisa Madigan’s own office was a prime example of the government compliance problem. In the years leading up to the FOIA re-write, she was one of the most egregious offenders of the Act. A State Journal Register investigation of freedom of information requests received by Madigan’s office in 2006 and 2007 revealed that she was late almost half the time in responding. Specifically, in 225 of 537 cases, Madigan’s office did not respond within the statutorily mandated seven working days.

Last week, General Madigan issued a legal opinion stating that the Illinois State Police would have to disclose the personal information of every law abiding gun owner within the Firearm Owners Identification Database (FOID) to the Associated Press. Since the 1960’s, Illinois forces gun owners to register with the state. Now, General Madigan is spearheading the legal maneuver to force the private information public.

Fifteen months ago in Champaign Circuit Court, Attorney General Lisa Madigan made the legal argument that “citizens of Illinois don’t have a fundamental right to a secret ballot”. The top law enforcement officer in Illinois advocates for a transparent ballot box. This egregious argument received scant attention. Thank fully, polls show that 90% of the public feels that the ballot box should remain private and sacrosanct.

As the top law enforcement officer in the state, has the Attorney General helped reign in public corruption? Lisa Madigan’s office has 712 employees and can’t find public corruption anywhere.
