Making Drew Rich

We'll start by saying we believe Drew Peterson to be guilty of any number of crimes. It's our opinion, we're entitled to it, we don't have to back it up with anything but a gut feeling, and it tells us Drew is a slick character. If you ever have to deal with him, check your wallet and count your fingers afterward. Twice.

But this prosecutor in Will County is going to cost the taxpayers millions of dollars.
  • Drew Peterson, the former Bolingbrook police sergeant, likely killed his 23-year-old wife Stacy using a choke hold in their bedroom on the Sunday morning family and friends first noticed she disappeared, Will County's top prosecutor said today.

    State's Attorney James Glasgow, who referred to Peterson as a "knucklehead" and "hideous B-movie stalker," laid out for the first time a theory of how Stacy, who disappeared in 2007, was killed.

    Glasgow's comments came during closing arguments in a unique pretrial hearing on whether hearsay statements can be heard by a jury in Peterson's upcoming trial for the 2004 drowning death of third wife Kathleen Savio.

Is there blood? DNA? Any form of scratch marks, claw marks, body fluids, spatter evidence, grainy gas station video, tollway receipts, cell phone pings, anything remotely available that ties Drew to a crime?

Nope.

And this Will County State's Attorney, who enjoys prosecutorial immunity, is saying Drew strangled Stacy using a choke hold in the bedroom on a Sunday morning? Based on what? A guess? A gut feeling? You can have all the gut feelings you want, but you can't prosecute based on a gut feeling and you can't stand the criminal justice system on its head because the guy making a monkey out of you is a "B-movie stalker." This isn't a game of Clue.

Here's the intelligent thing to do - suspend the case. Wait it out. There is no statute of limitations on murder. At some point, a body turns up, someone recalls a pickup truck driving by in the dead of night, technology catches up with the crime - it took 14 years for the Brown's Chicken massacre to come to trial. The system gets there, albeit not as fast as we like sometimes, but it gets to the finish line in some form or another.

Drew outsmarted the system for the time being. It happens sometimes, especially with psychopaths. But Drew has gotten a taste of publicity and he can't help but taunt the powers that be with how smart he is. Play to it and he'll screw up somewhere if he's guilty. Go to trial on this weak ass "hearsay" evidence that flies in the face of 230 years of law and Will County will blow what may be a single chance to bring a killer to justice. Not only that, the taxpayers will end up paying for lawyers, damages and Drew's ego-maniacal pathology to the tune of millions.

Isn't there such a thing as prosecutorial misconduct, similar to what the prosecutor in the Duke Lacrosse team debacle was charged with?

You're likely right, SCC. This guy will spend millions in tax dollars on a prosecution that will probably be overturned, just because Peterson is making them look like monkeys. Peterson's enjoying this all the while.

If anyone has ever seen Glasgow's he walks around like an arrogant tool. I have a distinct hate for prosecutors who grandstand. Its that arrogance that makes prosecutors so dangerous. They have the power to indict ANYONE with a scant of evidence.

I agree... drew was arrested way too early. they should have taken the time to build a solid case. This assho*e deserves to go to jail.. I know hes guilty... everyone knows he is guilty but you still need to prove it in court. Unfortunatly I dont think they have enough to get a conviction. I really wish they could have waited... as you said scc, no statute of limitations on murder.. this is a political prosecution that can backfire. if the prosecutors would have waited they could have built a better case and put this sorry excuse of a police officer away for good. Im proud to be a police officer.. this guy is just a wanna be jag*ff.. gives us all a bad name. I hope that he gets convicted and the families of the girls can get some closure.

SCC, you're right on target with this case. Glasgow is using the Peterson case to further his political career; in other words, he'd rather stay working on the public dole as Will County States Attorney than venture back into the private sector of vulturous ambulance chasing lawyers. This case won't come to trial until Glasgow has his next election and the rotten asshole will probably gets reelected. Like you, I believe Peterson is guilty; but you'd better have legitimate evidence if you want a conviction.

Anybody with a law or law enforcement background realizes Glasgow is fucked with this case. This is a horseshit case based on hearsay evidence. Unfortunately for Peterson, the citizens of Will County trust their States Attorney to be a man of honor. And a bunch of horseshit that is.

If Too Many Rectums had a blog like you and Shaved, I'd list Glasgow as my Chief of Assholes because of the shit coming out of his mouth.

One last thing: You're absolutely right about the technology aspect of solving murders. Too all you husbands thinking of pulling a "Drew" on the ol' lady, technology will eventually get you.

I don't agree, SCC. I don't believe his Stacy's body will ever surface. Drew may be a gum smacking smart aleck, but he's not stupid. After he got away with his third wife's murder, and decided to kill the fourth, he had all the time in the world to put her somewhere that will never be found. Kind of a weekend project out there in DuPage County - dig, dig, dig, then dig some more.
So, to wait for more time to build a case? nope - nothing more can be built. There is an outcry witness - Tom Morphy - who helped Drew carry a container downstairs at his home. And, like a child molester, he picked his helper quite well, a drunk whose done time in rehab - whose gonna believe him? No, I think this is the only way - using Drew's Law - to attempt to get the s.o.b. Glasgow is a strutter - but at least Drew will be sitting through the conclusion of this hearing. My money is on the Judge allowing most of the hearsay into trial - and then Drew can sit some more.

I agree SCC, Peterson is a worm, but the above statement sounds like something from a game of Clue, not something that a trained, supposedly informed lawyer would say. Especially one who is supposed to be a specialist in the prosecution of criminal cases. What a goof! Didn't these idiots learn anything from the Rolando Cruz investigation?

Thank you SCC, for writing this so clearly. There are so many flaws in the current prosecution of Peterson that it makes me ill. I hate it when courts turn into circuses -- or parodies of bad reality TV.

Peterson is an ego-maniac -- with time his behavior will catch up with him.

You are assuming the prosecutor cares. He's set it up so he wins. If he convinces a judge or jury (I'd take a bench if I was the defense), he gets a convinction. If he loses, he still runs for re-election as the guy who stood up for Stacy and whatever the other ones name is. He'll blame the lack of evidence but portray himself as the guy who couldn't just sit by.

He's playing this for politics.

This case is even more tainted than the OJ case. The media has run riot over this and he can never get a untainted jusy now. The lawyers and county officials just have to have time in front of the camera.
I just got back from Asia, some ex-pats there were asking me about the case! When even people in Hong Kong have seen the media circus, where can you find a unbaised jury?

I don't think he can suspend the Savio case. Drew has been arrested and charged and the "clock" starts ticking on this case. If his attorney, Brodsky, demands trial; Glascow has the alloted time to commence the trial. Any longer and Drew is free as a bird on Savio.

He should cut bait and concentrate on the Stacy case.

More often then technology it is ego that will eventually get the bad guy in cases like this. They start to think they are such a genius and just have to brag about it to someone who rats them out.

Or sometimes bad luck happens.

That is the way virtually all cold cases are solved. Technology can help, but its usually not what actually does them in.

It appears there is little in the way of evidence to support a charge of murder at this point, or he would have been charged. Best to just wait it out and see if eventually he does himself in.

I'll go one step further-the reason the Will County States Attorney is empolying the newly enacted heresay law ex post facto is because the target is a white policeman. As despicable as his alleged crimes are he enjoys the same rights as OJ Simpson, Hubie Geralds, or any other accused criminal. Listening to the Jody Weis railroading of Bill Cozzi presented by Bill's lawyer during last weeks hearing proves once again white policeman seem to have greatly diminished protections afforded by the US Constitution at the hands of a dogass like Weis, or Glasgow.

Until they've got more evidence, they've got no case. And for the State's Attorney to start speculating on the manner of death is about the most ludicrous thing I've heard in this affair so far.

SA Glascow probably went ahead with this case partly to apease the Savio family, who was probably bugging him every day with "what are you doing?" They were raising political stink with nothing going on, so to keep them quiet, he pushed for a rewrite of hearsay and went ahead. He has nothing to lose. No matter how the case goes, he gets famous and becomes a media legal talking head and makes big money without ever having to step in a courtroom again.

To the other mope comparing Drew to OJ not suing Marcia Clark and Chris Darden, there were little things all over the OJ trial called "evidence." Evidence led to a trial. The trail ended in an acquittal. You win some, you lose some.

With Peterson, the state is manufacturing evidence, which opens up the state to charges of willful misconduct and opens the taxpayer wallet, i.e. the Duke non-rape case.

That is not how the program works. You are advising harassment, which happens when people are desperate and do not have their ducks in a row. Patience is a virtue, and is also a necessity, in our criminal justice system. Hold your water. The truth will eventually be revealed.

I, for one, and it seems about the only one, truly hope he did not harm wife #3 and/or wife #4, not only for their sake, but to shove it down the throats of all you judgmental ass wipes.

I thought Drew was just being prosecuted for the "alleged" Savio death. I dont agree with letting all this heresay stuff in or making up specials laws for specific cases, but why in the world are they giving heresay testimony on the "alleged" death of Stacy? Are othey charginging him with that also? What relevance does the Stacy disappearence have in this case? Why were all those people able to speak about stacy in this murder trial for Savio?
I too believe he's guilty but this is a judicial sham not seen since Pontious Pilot.

We have them in CPD. The Morals police who target citizens simply because they judge others. Yet they are the first to get into trouble because of their views. They often cause us to spend millions of dollars in litigations.
