Contract? What Contract?

Who says J-Fed has to follow a contract? Contracts are for sissies:
  • The Superintendent issued AMFN 095065 which states that: Members assigned to Police Headquarters who have approved Personal Days submitted prior to 09 Dec 2009 will be allowed to use this time.

Section 11.3 of the current Collective Bargaining Agreement states that: Officers shall not be required to work on a personal day provided that written notice of the personal day is given to the appropriate supervisor no later than ten (10) days prior to the personal day .... Any dispute within a unit as to the selection of a personal day shall be resolved by seniority.....
Just because the contract expired 2.5 years ago doesn't mean the protections aren't in full effect. FOP points this out in the Current Updates section. Can someone get this guy a clue?

'scuse me, but our w.c. told us the same thing. Use it before the 13th period, or lose it. Most people freaked out and used their time in the 12th period, but there are a few still putting in for pdays.

Any denial of pdays will result in a grievance. WE still believe we have a contract, even if these goofy bosses don't.

What's new? J-fed circumvented department dicipline procedures and the state courts to punish Bill Cozzi twice for the same crime and send him to a federal hell hole in Louisiana for 3.5 years. What are the 35th street suck holes going to do? Complain and be sent back to the districts and have to work the streets and work weekends. Oh, and possibly pass up a merit promotion. I think not.

The FBI doesn't have a contract.

Look for more instance of the City just outright breaking the contract on articles they find unpleasant. then they force the FOP to go to court or to file and Unfair Labor Practice and then stonewall and force the FOP to arbitration.

Once in arbitration the City has at least a 50-50 chance of overturning the portion of the contract they find unpleasant and they didn't have to engage in that most disagreeable of activities: negotiation.

A contract is only as good as the people signing it and we all know how good daley's word is.

In my district a certain WC routinely does what they hell he wants and then plays dumb and the PO's on his watch are too afraid of losing a precious beat car assignment to sign a grievance form. Sheep the lot of them when they are supposed to be sheep dogs.

They haven't yet figured out that one stinking old beat car is pretty much the same as the next.

I see contract violations regularly but cannot get the harmed PO's to sign their name to a grievance.

Officers, if we don't stand up and defend our contract who the hell will? All these new breed fucks ever ask about is retro pay. never working conditions or contract provisions, just back pay. The bosses shit on them and they say "thank you sir, may I have another."

Many officers went through hell before us to get the contract protections we now have and we need to protect that contract. Too many PO's are willing to see the contract broken if they get some little benefit out of it. That is horseshit.

The reason most p.o's wont file a grievence is because they have no faith in the fop. Now that we are going to the four-two schedual the w.c. has more of a chance of turning on a p.o. many p.o.'s cant work the 2100 hrs start or the 0539start times. if you file a grievence and now have to work these start times all the flop cab say is the w.c. has the power to do so. The new start times were ment to give more power to the w.c's and to save overtime for the city. yes we no longer have to work a six day week but at what price ? I hope ou all have great bosses because if you dont follow the line be orepared to bounse times like a rubber ball.

he'd start making some intelligent moves by now...

On a P day today.

Know your rights.

The management cannot make you take your P days to fir their needs.

Heck, I may use one on New Year's Eve.

My choice, not theirs.

Now, if they want to hire me back at a premium rate, we may have a deal.

Before I retired I often stated that supervisors who violate the contract or already resolved grievances should take time themselves. The troops I advised to file grievances never lost one in the 20 some years that I was a supervisor. Right is right and wrong is wrong.

This was sanctioned by the Bureau of Administrative Services headed by that idiot Beatrice Cuello. Supt., if you would like to stand a chance, get rid of the idiots you surround yourself with like, Beatrice Cuello, Mike Masters and Debra Kirby. I do know they may kiss your ass well and have intentions that include the benefit of them, but your represent over 10,000 people. How can you keep back sliding then trying to fix BS based on their actions. This is just fucked up!

I work midnights so I will have to work, but didn't you realize New Years was coming a while ago? How is 9 Dec 09 the cutoff? New Years is the same day every year! I am sure the old timers have paid their dues and did their time and should not be forced to work on this day! You also need to remember that working at HQ is no fucking perk. Everyone I know and I mean everyone are going back to a District after the new days off come into effect. I bet you didn't see that one coming did you stupid Policy Group and Stupid Aunt Bea! Idiot!

I agree. Not one of those gold star assholes stood up for Cozzi. Those suckholes sold their souls to the devil.

I write to Bill a lot. I encourage you all to send letters and cards. J-Putz should rot in hell for that alone.

Watch selection and time due contractual protections DO NOT cover officers who are not working in a bidable unit.

Officers in "special units" can have both their watch, furlough, and time due selections limited based on the needs of the unit.

And your surprised that "Gangs" was removed from the districts and turned into a specialized unit. That means no time due for you!!

I do not feel bad for officers that disgarded their contractual protections, so they could avoid having their assignment based on senority.

"and that
the granting of the personal day does not adversely affect
Department operations."

The above section is from 11.3 and it is based on this that they will say they have the right to deny any personal day submitted after 9 Dec 09.

The contract is only as strong as the labor organization that defends the collective bargaining agreement. I remember S.B. and T.F. always saying I would never tell anyone not to file a griv, but when it came time to pursue the griv., it would die because of union b.s.

What's the worst thing they can do to you except bounce you around and change you from an early car to a late car. They going to make you handle twice as many calls. you can only do so much. If the paper and arrest take you 2 hours they can't make you go faster.

Even if you put a Personal Day in a timely manner, it can be denied. As long as no one gets CU, BFD, or VD, (unless during vacation segment), they can still be denied.

Moron. Read the contract. A P-Day has to be denied, IN WRITING, no later than ten days before the requested P-Day or it is granted by contract.

Half the department should put in for the 31st off and get it denied based on this stupid horseshit AMFN order and then file grievances and let the jodeymeister explain to 42 short why he is now paying out lots of OT to settle grievances.

Hey MORON, You are a dumbF*&! If a large number of people put in PDAYS moron obviously someone is going to get denied. That is why the last chance to put in for a PDAY is Dec 21. You can be DENIED a PDAY MORON or should I call you ROOKIE.

Hey, moron yourself, the whole issue was the AMFN message that jody issued stating that if you didn't have your P-Day in by Dec 9 then you weren't going to be allowed to use it on Dec 31.

10 days prior IS by contract, Dec 21, NOT Dec 9. Dec 21 is according to Hoyle, Dec 9 is jodyspeak for fuck the contract.

Read the original SCC post which references AMFN 095065

Used to happen at some special units where a certain group of people felt they were entitled to be off for the holidays to be at home and held their P days until the last minute and then wanted the days between Christmas and New Years. I know there are 5 days between and you only get 4 PD's but that is what happened and mostly the whole unit wanted off or felt they were entitled to be off and didnt feel that seniority should rule

A) you CANNOT take a personal day on a holiday; B) a personal day CAN be denied by the watch commander for manpower reasons. These tidbits come courtesy YOUR contract.
