Another Ridiculous Lawsuit

  • The truck driver who plowed into a Red Line station in Chinatown last April, killing two people and injuring 21 others, suffered a "medical condition" just before the crash, a federal lawsuit filed by the truck driver's family alleged.

    The lawsuit filed by Donald Wells' wife, Ann Darlene Wells of Metamora, Mich., alleges that Chicago police ignored pleas by family members for medical treatment for Wells, who was "talking incoherently . . . and otherwise behaving abnormally" during the 48 hours he was in police custody.

  • Wells, 64, who was suffering "from a mental condition and...experiencing severe physical and psychiatric ailments" while in police custody, died of pneumonia and multiple organ failure in June, the lawsuit said. The suit alleged that police indifference to Wells' medical condition contributed to his death. The suit names the City of Chicago and numerous police officers as defendants.

    The Tribune reported at the time of the crash that Wells was taken to Stroger Hospital immediately, but he refused treatment in part because he had no health insurance.
He was in the wreck in April of 2008, made bail within 48 hours, died in June and the Chicago Police Department is responsible how exactly? And that last quoted paragraph...

Ex-squeeze us? He had no health insurance? Would the family and scumbag attorney like us to take them on a tour of Cook County Hospital? We're going to bet 75 to 90% of the people who go through those doors have minimal, if any, health insurance. Lack of insurance isn't an impediment to receiving medical care in this country. Hospitals routinely eat hundreds of millions of dollars for the uninsured, the under-insured and the illegal.

How about a directed verdict on this one?

SCC, look at it this way. Being that we live in Crook County, some oblivious jury will award his family millions of dollars. Its sad to say but its true. That being said, hopefully the families of the two people that died as a result of the crash are paying attention to this and sue the driver's family for wrongful death and get those millions.

Unfucking believable! This goof truck driver's irresponsibile, and most likely willful and wanton behavior kills and injures innocent victims and she now cries victim! My sympathy for her being involved as the wife of this nut is completely gone. I hope the victims get every red penny from his estate and she gets to live in a van down by the river. Too bad the scuzzy, ambulance chaser lawyer can't be punished for taking this frivolous case.

Well if he was driving then he would have insurance, since it is required by law. And insurance will cover his medical expenses when in an accident, that's the point of insurance... So while you may not have your own medical insurance, the car insurance will cover your medical bills.

Doesn't sound right. Stroger is a free hospital, you don't need health insurance. And if he didn't get treatment he needed it is up to the hospital, not police, CPD took him to the hospital immediately.

If he didn't have health insurance it is a safe guess that he didn't have life insurance. So, they are trying to cash in on some life insurance in another way.

Can't people accept that their family member might just have had some type of mental short circuit, killed two people himself and then dies due to his own underlying medical condition?

No medical insurance, that likely means he had not been treated or examined for anything in quite some time.

Whose fault is that? Certainly not his loving family. Yeah right. Another attempt at cashing a City of Chicago lottery ticket.

If he was talking incoherently at Stroger they'd assume a head injury after a major crash and not let him go. It also sounds like the guy had pre-existing health issues that should have kept him off the road. In any case his estate is probably getting sued by the actual victims, and the family is looking for any source of money. Anybody have a crash lately and the other party has deadbeat insurance? They just wait you out till your company gives up. I don't think the city will even try to settle this one in the hopes that the family is ate up by their main legal problems. This is gonna die on the vine.

I heard of a person who used to reside in crook county and move to another state, developed cataracts in both eyes. This person then came back to crook county and had both cataracts removed thanks to the tax payers of crook county.

Its up to the court system to deal with these kind of situations and for the jury to decide just what the facts are and what the judgement should be.

If what SCC is claiming is true, it seems unlikely any jury would award money damages.

However, there is often another side to these kind of stories.

Only to the amount of medical coverage you have on your policy, be it 1k, 5k, 10k or 100k. You can also elect to not carry medical coverage on your policy, if you don't want to pay for it, which I'd bet this jerkoff did.
But the real question is why didn't he just go to the hospital if he was that ill?
I smell bs.

Every hospital will take everybody that comes into the emergency room for treatment regardless of insurance or residency. They are required to give emergency medical care.

There is no such thing as a FAILED LAWSUIT against the City.

The Corp Council first, will estimate their cost to fight the suit in lawyers salaries, legal research, court preparations, court exhibits, court files, discovery, motions, continuances, depositions, communications, other City employee salaries and overtime multiplied by the number of motions and continuances, etc.

Once this cost is determined, say $20,000 for example, the Corp Council will offer a settlement of, say $10,000, figuring that this is a $10,000 SAVINGS for the City.

GREAT ! Corp Council tells Richie they saved the City $10,000;

SLEAZY LAWYER skims his one third or $3333 off of the $10,000 he "won" for the grieving widow for doing nothing but being a Friend of The Mayor;

GRIEVING WIDOW gets her $6666 which is a lot more than she expected her husbands unfortunate death would get her;

THE MAYOR gets his kickback fee from the "friendly lawyer" paid directly to either The Chicago 2016 Fund or The Richie Daley Mayor For Life Campaign Fund;

THE CORP COUNCIL's bevy of clouted "lawyers" get to continue pocketing/stealing their exorbitant salaries for doing no discernible lawyerly duties;

THE TAXPAYER continues to pay and get screwed as always !

The reason he's suing is because 'past practice' of the City of Chicago is to give people money when they sue the CPD because it's cheaper than paying the lawyers to defend these nonsense lawsuits. The Corp. Counsel is inept and so they farm these cases out to these (favored) law firms.
I respectfully disagree with your premise that it should just be tossed out as frivolous. I think they should be monetarily punished if/when they bring these BS cases to court to discourage these bottom-feeders from suing us just because it's 'free=money.'

The last statement is totaly wrong Cook County Hospital like every hospital can not refuse any patiants, they do have the right to stabalize you and ship you off to another hospital..... Take a ride up and down ogden ave in front of the hospital and see all the out of state plates parked in front of the hospital in the middle of the night. People come form all over the state and surrounding states to get free medical treatment. Known fact.

If you walk into Emergency Services at ANY hospital - with or without insurance you still get treatment. If not, then how do all these illegal aliens get "free" treatment?

If NO insurance equals no service, NO citizenship should equal no service as well.

Sorry if I sound hard but too many freebies has got us to this point in the economy. If you don't agree, better start doing some research on how much money all these giveaway programs are costing us.

Look at OCTOMOM - she is supposed to cost California $5 Million in medical costs - JUST FOR THIS YEAR. Who picks up the tab for her? EVERYONE - especially as they get paid out of the Stimulus package (Fed Money) to pay off state bills.

I believe everyone that goes to a E/R for treatment cannot be denied emergency treatment due to lack of insurance at least thats the way it is in NY.

Off The topic: There was a previous topic about the INFAMOUS 43X. Whoever described him in that post sure does know him well. I too have worked for him and had to endure his rants about how much better he was then certain people. One warrant in his whole career for a little coke, but thats all we heard about. By far the worst boss i have worked for but not for his knowledge, but horrible people skills. He should be replaced and put on a watch, then he can see who the real police are!

people really need to stop worrying so much about lawsuits. when i go to work everyone gasps when the they find out they or someone on the watch is getting sued. now, i understand maybe 15-20 years ago people may feel this way but now everyone is getting sued for anything and everything. lawsuits are just becoming part of the job. everyone knows that the city has deep pockets so they will sue. a lawsuit these days means nothing other than overtime. people need to stop worrying. of course the lawyer and bad guy are going to make rediculous allegations in the complaint but so what... they have to. if they dont trump up the charges on the complaint they wont get paid. we just all have to understand that the lawsuits are going to keep coming, weather your a worker or not your going to get sued... just dont forget, the only thing a lawsuit means is overtime for you... your not gonna get in trouble and nothing legally is going to happen to you...its all civil and the judges and attorneys know this... its just a new game now.. so relax everyone... its only a lawsuit and they are becoming as common as cr numbers...everyone freaked out in the late 90s/ early 2000s when cr# started piling in with ops... its just how things are going to be from now on. i forsee that in the future the majority of arrestees with private lawyers are going to sue after the trial is over just to see if they can get some cash.

WRONG.No hospital can refuse anyone medical care or treatment. Signs posted everywhere. Now, stablizing him and transfering him to another hospital? That's a different story. 99.9 % people who seek treatment at County Hospital, have no fucking insurance, and get treated for free. You and I? This is not true. You mean a guy who lives outside the county and is brought in by ambulance is refused treatment because he cannot show proof of health insurance? By law they have to render Emergent Care!

However, if he needed additional elective or corrective surgery that was NON-LIFE THREATENING, he would either have to have health insurance or return to his county or state of residence.

The fact is this: The truck driver refused medical treatment because he was hiding something!!!

They, like other hospitals, are required to provide emergency care regardless of insurance or not. And if, during the emergency examination a possible life threatening condition is discovered the hospital is required to do something. Something besides discharging him that is. Something like provide care. Regardless of race, religion or political affiliation.

Here's the crazy part about that accident. Before crashing, he had to make a choice if he was turning left or right at the approaching intersection, but even more crazy was in order to get to that point, a driver (every driver) has to manuveur through a difficult 4 Lane "S" curve coming off that I55 Chinatown Exit Ramp. When they do, their usally greeted by a stop light and some right turning arrows. So, no matter what, you have to reduce your speed just to complet that "S" curve, and without crashing into any other vehicles next to you. This guy came out of that curve and sped up, or was flying around that "S" curve, and didnt bother to reduce speed or to even make the stop. My point? This guy had to be on something. Alcohol? Abusing Drugs?

you will better care at county than you will at some of the other so called private hospitals. my sister lost her job and insurance and wouldnt you know my 12 year old nephew ruputered his appendix he got a one care there, and a bill that our whole family helped pay. goober is 19 and here now. maybe the city should sue darlene since she had knowledge he had mental problems and shouldnt have been driving. i hope that young girl who was buying her prom dress and all the other victims sue darlene and michigan for giving this asswipe a license.

That's why lawyers should never be elected to make laws.

Hell, it's bad enough that judges are lawyers.

If a candidate for a legislative office, on any level, city, state or federal, is a lawyer, don't vote for them.

A non-lawyer legislator can always hire the legal advisers needed to vet proposed legislation for it's constitutionality, just as they can hire economic advisers for proposed legislation relevant to the economy, science advisers for proposed legislation relevant to scientific issues, engineers, architects, accountants, etc.

It's the intelligent and honest citizen whom we need representing our interests, not the tunnel vision freak personalities which make up most of the lawyer gene pool.


Rule of thumb: Never vote for a lawyer.

Make exceptions at your own peril.

There is no such thing as a FAILED LAWSUIT against the City.

The Corp Council first, will estimate their cost to fight the suit in lawyers salaries, legal research, court preparations, court exhibits, court files, discovery, motions, continuances, depositions, communications, other City employee salaries and overtime multiplied by the number of motions and continuances, etc.

Once this cost is determined, say $20,000 for example, the Corp Council will offer a settlement of, say $10,000, figuring that this is a $10,000 SAVINGS for the City.

GREAT ! Corp Council tells Richie they saved the City $10,000;

Why did the Retiree’s Trustee, Kenneth Hauser, vote to continue paying along with 2 other city appointed trustees? Kenny’s vote would have made it a 4-2 in favor of stopping this madness!

To answer why Ken Hauser voted to continue the payments, it is because Hauser doesn't do anything to help us, the officers who pay into that pension fund. He did nothing but what he was told when he was the active PO's rep on the board and continues the same long pattern of being the ditiful dumb Daley man in retirement.

Hauser has got to go, he should have been launched long ago. When the fund was flush no one cared. Now maybe people will pay closer attention as their pension money gets spent like Congress is doing the spending.

Mike Shields is the first PO to sit on that board to actually stand up for us.

Congrats Mike.

Uuummmmm....because it's wrong. Because that's what we do for a living, right wrongs. Because we hate to see bad people getting taxpayer money, OUR money. Because there is something horribly wrong with this system when it actually pays people for doing wrong. At least that has been my experience.

It's happened to me, so I'm relating it here. Don't take it personal, brother...

When the city settles these BS suits, some of which are sooo outlandish they don't even bother informing you of the suit or calling you in for an interview or deposition, it still is subject to disclosure upon a lawyer filing a motion for discovery.
Now lets say for the sake of discussion the city settled, ah... 3 times on real BS beefs. (i.e...."that Officer X jumped off the moon and hit Plaintiff Y with his saber etc.")But... the city gives the goof $500.00 and he goes away. (It would cost $3,500.00 at a minimum just to file a brief)

Here's my point, bro'. Now some time in the future you get a heater-beef that's going to a jury trial. The lawyer is suing the city and you for damages. At some point in time the lawyer will ask you, "Officer have you ever been sued before for action(s) while acting as a police officer?" (or words to that effect) Now if/when you answer "YES" you just tainted that liberal, police-hater jury vs. YOU even further. Chi-ching! If you answer "NO" because you were unaware of the city settling real BS beefs vs. you for a few hundred or thousands.... the attorney then produces as 'Exhibit A' your background obtained via Motion for Discovery and states that you were in fact sued 3 (or fill in the blank) times and EACH TIME THE CITY SETTLED via payout. Your credibility is shot and you just enhanced the likelihood of the court/jury awarding a judgment against you as well. While the city must represent you while in the performance of duty, you 'may' also be sued 'personally' and held liable.
Sorry for the long rant, but my point is the city does not do you any favors when they settle. That court record stays with you throughout your entire professional as well as personal life.
My point...It could come back to bite you in the ass someday.

Its up to the court system to deal with these kind of situations and for the jury to decide just what the facts are and what the judgement should be.

If what SCC is claiming is true, it seems unlikely any jury would award money damages.

However, there is often another side to these kind of stories.

You are obviously not a police officer and have lived in a fantasy world. More often than not, juries are the dumbest groups of people in the world. The court system is a farce. Cases are only prosecuted based on money and politics. Not enough ASA's for the case work that needs to be done, and not enough $ to pay the short staff overtime to develop these cases. And also, not enough $ to hire ASA's that have more than half of a brain.

who cares what goes out of the pension fund. what you care is whether your benefits get paid.

the trustees do have a fiduciary duty though, and you might want to file a complaint with the IRS if it bugs you enough.

I suspect it won't go anywhere.

OT a bit but heres one under"screwed up judicial system."

The monique bond look alike judge at Br-46 (304) on 27 Feb 09 must have been hitting the pipe hard in chambers today. A case was presented where as the defendant(an impoverished M-1)ARE YOU IN SHOCK??? was before her for 1330 and Assault. The complaining witness beautifully delivered the facts of the case much to the chagrin of the Sleaze lawyer the defendant(or our taxes) paid for. Assault was PROVEN and so was the CTTSSL.However the Judge claims that the agent for the property cant exclude subjects and has to allow reasonable time for the alleged offender to leave before placing them in custody.Wait exactly how long your Honor? til the crack head goes and comes back with a gun? I was always under the impression that once advised to depart THAT MEANT NOW not when they feel like it. During final summation prior to ruling, The Judge misquoted names,confused defendant with complainant,could barely read her own notes,and stated that the "victim" (offender) was more credible than the officer( a 23 yr vet with Housing.)Needless to say the mope was found not guilty and the Officer in closed quarters with the SA vented.Cant blame him at all. This is another reason why the City,State and Country is messed up. BTW, The Officer got an indefinate suspension from his boss for "being an embarrassment" (by venting obvious frustrations in accordance to his Freedom of Speech.) Insofar as Spine and manning up...the Officer in court Clearly showed vast testicular fortitude. Too bad his boss is still looking for his along with a recognizable SPINE. I spoke at length with this Officer and the only "embarrassment" I can see is that he still works for this jellyfish asshat.Chances are the suck hole this 'boss' is protecting will move right into the vacancy left by the above mentioned. Thanks SCC.

let me CLARIFY that SUSPENSION. This guy is a Well known Guard in privaesector,in public housing who HASNT LOST A CASE IN OVER 20 YEARS( Big surprise in Cook County) I actually felt bad for the guy as he left. But one thing he did do that impressed me. He went off on the 23 y/o States Attorney that didnt defend the Charges at ALL in the proper way. Im assuming its for THAT that he caught some time. it never ceases to amaze me why they continue to hold down good forthright people who take the time to fight with the shit head,arrest and process the shit head and then turn the shit head loose.This guy would have made an Excellent PO. Articulate,direct,educated,and consise in his testimony and delivery.The crack pot judge is the one that he SHOULD have barked at. But then again we can leave that until Election Day. I guess we arent the only ones getting SCREWED in Court.

Lost a few infront of crack pot Judges myself(Lubin,juvenile court) but those of us that have the Testicular Fortitude will get right back on the horse and fight the battle one more day........Insofar as that Judge is concerned you HAVE recourse. Election day(vote her OUT).Aside from that pass along my support to the guy and better hunting NEXT TIME. There will ALWAYS be a NEXT TIME.
